Was just hoping I could get someone to proof read our cover letter and make sure we haven't missed anything, thanks in advance :D Adjusting from J1 with no 2 year residency requirement hoping to get it sent off this week.

I-130:

  • Payment in the amount of $535.00, personal check for filing fees
  • Form I-130, signed and dated by Petitioner
  • Form I-130A Signed and dated by Beneficiary
  • Copy of Petitioner’s Birth Certificate
  • Copy of Beneficiary’s Birth Certificate
  • Certified copy of Marriage Certificate
  • Two (2) passport-type photos of Petitioner (Full name and DOB on back)
  • Two (2) passport-type photo of Beneficiary (Full name and DOB on back)
  • Evidence of Bona Fide Marriage, including the following:
    • Copy of joint car insurance
    • Copy of Petitioner & Beneficiary’s checks showing shared address
    • Pictures of Petitioner & Beneficiary at various points in relationship
    • Copies of Petitioner & Beneficiary’s passport stamp pages showing shared travel
    • Copy of travel voucher showing shared travel while Petitioner & Beneficiary were dating

Enclosed please find form I-485 along with its supporting documents.

In addition are forms: I-765 Application for Employment Authorization and I-131 Application for Travel Document along with their supporting documents.

  • Payment in the amount of $1225.00, filing & biometrics fee; personal check made payable to U.S. Department of Homeland Security.
  • Form I-485, signed and dated by 
  • Two (2) passport-type photos (with full name and DOB on back)
  • Form G-325A Biographic Information sheet
    • Additional information for Form G-325A
  • Copy of passport (all pages)
  • Copy of Most recent I-94
  • Copy of birth certificate
  • Copy of DS-2019 which provides proof of current visa and evidence that intending immigrant is not subject to the two-year residency requirement

Form I-864 and supporting documents

  • Form I-864 signed and dated by 
  • Copy of Petitioner’s Federal Tax Return for 2016
  • Copy of Petitioner’s Federal Tax Return for 2015
  • Copy of Petitioner’s Federal Tax Return for 2014
  • Copy of last 3 months pay stubs

Form I-765 and supporting documents:

  • Form I-765, signed and dated by 
  • Copy of passport page showing picture, name, and date of birth
  • Two (2) passport-type photos (with full name and DOB on back)
  • Copy of DS-2019 which shows current visa status as well as proof that intending immigrant is not subject to the two-year residency requirement

Form I-131 and supporting documents:

  • Form I-131, signed and dated by 
  • Two (2) passport-type photos (with full name and DOB on back, no A number to provide at this time)
  • Copy of passport page showing picture, name, and date of birth, as well as the I-94
  • Copy of form DS-2019, certificate of eligibility for exchange visitor J1 status, showing present status in the U.S.

Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

First question , Can you actually file I-485 without an approved I-130 ? Not sure,  so this is why I am asking - I think you must first receive the approval and then AOS.

 

Secondly, I would probably beef up the evidence of bona fide with more documentation - such as health insurance cards, credit cards in both names or he could just add you to his account if you don't have credit history, lease showing both residing and taking financial responsibility for the lease, 401K beneficiaries updated to show spouse, etc

 

As organized as the file is, I am afraid it may be overbearing in the same package and items may get lost , misfiled as all the applications do not follow the same path etc.... Plus I am thinking that they would not actually be able to accept all the checks without the I-130 approval first.

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

You should put the g-1145 on top of the I-130 and I-485 to get text and email notifications

 

You need to include I-94 in the I-130

 

you need the I-693 civil surgeon exam in a sealed envelope for the beneficiary, it's required for the I-485

 

i believe you need to include your W2, 1099's (if you have those) and other documents you used to file your 2016 taxes

 

im on mobile so I can't see your country, but if the birth certificate is in another language you need a translation

Candybabe - Great thanks! Will try to figure out some more evidence, kind of limited at the moment but will definitely have a bit more.

Yep you can do a concurrent filing of them so no problem there :)

 

Thanks Apfel! This is why I get people to proof read, I'd put those in but had completely forgotten to put them in the cover letter. Birth certificate is Australia so no translation there.

Will add the W2's etc tonight!

Ausmad, your cover letter looks good. Depending on the length of your marriage, you can add the bona fide evidence that you have and bring the originals and any additional evidence to the interview.  These can include wills, life insurance beneficiary, joint bank statements, joint health insurance etc. The I-130 instructions for evidence of bona fide marriage states:


(1) Documentation showing joint ownership of property;
(2) A lease showing joint tenancy of a common residence, meaning you both live at the same address together;
(3) Documentation showing that you and your spouse have combined your financial resources;
(4) Birth certificates of children born to you and your spouse together;
(5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital
relationship. Each affidavit must contain the full name and address of the person making the affidavit; date
and place of birth of the person making the affidavit; and complete information and details explaining how the
person acquired his or her knowledge of your marriage; or
(6) Any other relevant documentation to establish that there is an ongoing marital union.

 

Of course, as an immediate relative of a US citizen who is currently residing in the US you can submit I-130 and I-485 together. If you have not already done this, go through the guides on VJ  http://www.visajourney.com/content/i130guide2

You need 8 total, 2 for each of the forms you listed for the beneficiary and 2 for the petitioner with the I-130
