Can the spouse bring their child along after the CR-1 visa is complete?

Hello. 

 

What if my spouse gets pregnant along the way of the CR-1 visa completing? Do I need to file another visa for the child? If we do have children, we plan on them being born in her home country. If the CR-1 visa is complete by the time the child is one year old, do I need to file another visa or him/her?

Nothing changes if your wife is pregnant during the process - besides the fact that she may not be able to travel if she's in the third trimester.

If a baby is born before she receives the visa, however: https://travel.state.gov/content/passports/en/abroad/events-and-records/birth.html

You will also need to file CRBA if you do choose to have children out of the country. 

I don't need answer to this but, just for you to think on: are you sure you want to have the children in her country? You generally shouldn't travel in the third trimester, so if she's pregnant while she's in the US, she will probably have to return to her country for three to four months. Plus you have to go through all the CRBA paperwork to get them US citizenship. If they are born in the US, they will be citizens at birth. Just some food for thought! Again, I'm not asking because I want answers, just some things to think about for yourself.

So does this mean I only need to file a CR-1 visa for my wife, and then she can bring our child over without any additional documents (aside from the CRBA, which I will do later)?

Your child will be a US citizen by parentage, because they're your child. US citizens don't need a visa to enter the country.

The US have weird rules when it comes to citizenship. A foreigner's child, with no ties to the US, will become a USC if born in the country but a USC's child will not become a USC if the USC parent have lived too long abroad.
