Visa renewal, AOS after red flag on B2

My friend's-friend (a foreign national) got caught trying to defraud a USC (attempted marriage fraud) using her B2 visa.

 

The USC found out and cancelled the 129F petition before the K1 could be issued. A red flag was issued on her visa and she is stopped in secondary inspection every time she enters the U.S., questioned, inspected to ensure non intent to immigrate but ultimately let through. She still however has 6 months before her B2 expires.

 

She obviously wants to renew her B2 or try to adjust her status some how from within the US with a new petitioner (TBD).

 

What are her chances of renewing her B2 (or getting any other visa) or being able to adjust her status from the U.S. with an attempted marriage/fraud on her ledger with USCIS and CBP?

Well. If they put the "no aos " annotation on her b2 then obviously she cannot adjust her status. I assume they would do that. I also think the chance of her getting a New b2 are slim to none. Surprised she didn't have her current visa taken away. Sorry to say that but your friend deserved all that for attempting fraud. Especially stupid move with the new immigration rules being more strict.

Plenty of people here have adjusted successfully with that written in their passports. It holds no legal weight, and basically makes the CBP officer feel good about himself. 

 

OP, I would expect a slim to nonexistent chance of obtaining another B-2 immediately after the current one expires.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

@roel - not sure if they put the "no AOS" in her passport or not, would that make a difference when she goes to renew her B2?

 

@macUK - She obviously is "desperate" to come to America so yes by the sound if it she will be trying other ways now.

 

@az2014 - Who said anything about me helping her? I hardly know the girl. I'm actually here out of curiosity to see how successful her future attempts would be at renewing her visa, getting a new one or adjusting her status because I personally don't feel that she (and others like her) deserve it.

 

Update - I was talking with my friend earlier tonight actually, turns out her friend is now involved with "a very wealthy and well-connected LPR from South America" who knows about the attempted marriage fraud and who is trying to "help her adjust her status some how."

 

This would be unfortunate if this would happen.

But this is exactly why the immigration laws are strict and will be getting even worse. If I were you, I'd report her to the USCIS. Friend or not.

I'm curious about how all of this will turn out given the new stricter immigration policies. I truly do wonder how the new rules would effect a case like this compared to the old administration if at all. 

 

All the attention on Trump's immigration reform is on the Mexicans illegally crossing the border, the 9 banned countries and H1B visas. There's not much said about visa overstays and status adjusters and k1/k3's.

 

The foreign national in question I'm sure won't be outside the U.S. when her visa expires. She'll try to adjust her status some how from within the U.S.

@KierenHby - Yes she is now. She is supposed to go back to her home country this weekend actually but to be honest I'm not entirely confident she will despite being told by CBP to and having a return flight ticket.

 

Which again is the reason I'm here on this forum. Wonder what's going to happen to her if she doesn't return home as she was supposed to and stays in the US while her B2 expires and tries to adjust her status some other way with an attempted marriage fraud on her record with USCIS.

@KierenHby - I'll be updating this thread regularly with anything new I hear about this situation. 

 

I doubt ICE will care about a B2 overstay. I'm sure triage takes precedent here with violent criminals aliens being their top priority.

Tell her good luck...proving a fraudulent relationship as legitimate after having previous been found to try to commit marriage fraud is quite a battle. Many legitimate relationships have a harder time than necessary already.
