Will be putting together the RFE response packet tonight. Another question....the box  next to "proof of bona fide marriage" was checked, but ONLY the 2016 IRS tax transcript item from the list of examples was circled. I'm planning to just send the tax transcript and none of the other items (lease, credit card, insurance, etc.) because they weren't circled. Any thoughts about that? Would it help to send additional evidence of our bona fide marriage, although not specifically requested? 

I would just send the taxes since that was specified in the list. I'm of the thinking with USCIS now that if they don't expressly ask for it, I'm not sending it, extras can come to the interview with you guys :)

We had our interview this morning. Everything went well. The lady interviewing us was very nice and polite. She went through a series of questions for both of us taking turns to respond, they included birthdays, jobs, our address, what we did for my birthday that was just a few weeks ago, etc. Then we showed her some photos and she started asking my wife about all my relatives in it, she knew all the names which surprised me because I wouldn't have remembered my cousin's boyfriend name or the name of my mom's friend.

 

She asked for a new medical as the one we submitted had expired, which we didnt have, she said we have 90 days to submit it and that she'll approve it afterwards. She also suggested that it would be better to wait 20 days before submitting it, that way we'll be over the 2 year anniversary and we wouldn't need to file again to remove conditions. So in the end everything worked out well.

I will second waiting that 20 days. In hindsight, I wanted the GC as soon as possible, but skipping ROC has been great, knowing no more USCIS for 10yr if we choose to is a wonderful feeling

So good to hear all went well, I agree with the waiting 20 days too, we were over 2 years married when we got our green card, so nice to not have to deal with them until the naturalization for sure!!

Congrats on getting past this final hurdle, Elikhom! Although I don't have the experience myself, I definitely agree with Sparkles and PaddyGirl that waiting to submit the medical and avoiding ROC sounds like a terrific idea!

Thanks for checking up on us, Sparkles. I just sent in the RFE packet on Saturday; should be arriving today. I left the receipt at home, though, so I'll have to track it after work tonight. Of course, I'm freaking out because I forgot to write "RFE" on the outside of the USPS priority mail envelope before mailing it, but it's written on the manila envelope inside the package and also on the cover letter my hubby sent. So, should be fine and I just need to relax. 

 

Do you happen to know the average response time for an RFE? Any chance they'll still approve us without an interview?

I think it is 30 or 45 days, I can't recall exactly which. And yes, I think you still have a 50-50 chance of no interview. The RFE stuff might satisfy them on that level. I'll cross my fingers you guys get waived.

OK, mailed the RFE package on Saturday and this afternoon received a text message alerting me that our case status was updated on the USCIS website. I signed in, clicked on the i-485, and it said YOUR CASE HAS BEEN APPROVED!!!

 

That means the green card will soon be in the mail without interview, right? RIGHT?!?!??!

YES, GIRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRL, YOU ARE DONE!!!! *virtual hugs*

 

They say up to 45 days, but ours showed up I think 5 days after we got the notice of card production/mailed, and that notice occurred 2 days after official approval. So about a week total.

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:
