Hi @sandranj

you said Vermont may take 60 days to issue the Prima Facie Determination, if you did not  you receive in 60 days then send a letter to VSC requesting  "supervisory review". Is this 60 days  from the day they received the I-360 or is it 60 days from the day they received answer to RFE

The suspension of the interview for I-485 (filed with 1-130) was granted, not approval of the I-485.

 

I could not find any information on USCIS website that explicitly state what an applicant should do about a pending I-485 (filed with I-130) should the applicant decides to file VAWA I-360.

 

I decided to file another I-485 based on VAWA because there is no explicit information on USCIS website about what to do about the pending I-485 (filed with I-130) when someone files VAWA.

It states "immigrants who have applied for relief under the Violence Against Women Act and other similar programs have had their private information exposed because they are undocumented. Attorneys fear that the database will allow abusers and traffickers to track the locations of their victims, interfere with their cases and inflict further violence."

 The website basically notifies certain individuals about those charged with a crime, and those convicted of a crime. Vine informs the alien’s custodial status with ICE, showing if the person was released from ICE custody, deported or if the person is still in custody as well. Information regarding who applied for VAWA is blocked from DHS-VINE.

 

As states by DHS  "...the DHS-VINE ensures that eligible registrants are aware that a particular alien is either in ICE custody, has been removed from the United States, or has been released from ICE custody. This awareness allows registrants to take protective action (such as contacting law enforcement or other protective measures), if necessary".

 

"...Identifying information belonging to an alien who falls within certain protected classes will be blocked from ICE’s Online Detainee Locator System (ODLS) for the alien’s safety, and therefore, will also be blocked from DHS-VINE.11 Specifically, an alien who has applied for, or was granted protection under the Violence Against Women Act (VAWA) or a T or U nonimmigrant visa, as a matter of law and policy".

 

 

Note "...With respect to aliens who applied for, or were granted protection under the Violence Against Women Act (VAWA) or the T or U visa, ICE will add a code to their record during initial book-in to mask them from ODLS". 

 

Note: "...Officers will make a notation in EID for any aliens who belong to a special protected class, whose information is blocked from ODLS and DHS-VINE. Information regarding minors is also blocked from both."

DHS states regarding the use of  DHS-VINE "...It is a violation of 8 U.S.C. § 1367 to “permit use by or disclosure to anyone (other than a sworn officer or employee of [DHS] for legitimate [DHS] purposes) of any information which relates to an alien who is the beneficiary of an application for [VAWA or T or U nonimmigrant status].” This limitation ends only when the application for relief is denied and all opportunities for appeal of the denial have been exhausted. Officers will make a notation in EID for any aliens who belong to a special protected class, whose information is blocked from ODLS and DHS-VINE. Information regarding minors is also blocked from both".

Don't understand. Copy pictures on computer ? And where to insert? I just did mine like saperate pictures printed of every screen shots of messeges. But I don't send yet.

That's fine too, as long as you obtained a physical copy regardless of technicality or format. if it's on paper it's good.

Hi Sandranj,

   I want to apply for my advance parole. I had been out of status for sometime. Assuming I get advance parole approved can I travel outside the country or will it trigger for ban? 

I am confused because USCIS says advance parole approved would not trigger the ban. Is it true?

AP does not guarantee reentry.

Many people out of status traveled with AP and returned to the U.S without any problem, well they entered before the nut job became President.
