Not for certain, but I think anything that falls under the Adam Walsh Act, which are sex crimes mainly against minors. I think domestic violence makes it difficult. I haven't filed yet so I don't know for sure, but I have an aggravated assault charge on my record so gonna find out. I have asked about that before on here, some say it will be a problem, some say it won't. Apparently no one on here has any crimes on their record, that or they are to embarrassed/ashamed to admit it. Also, you can google Adam Walsh to find out for sure what those are.

Has to be someone on here though that has gone through the CR-1 process with some convictions of some kind who could give a better answer as to what to expect.

Any type of immigration fraud or people smuggling crime would cause the petition to be denied.

My husband has a criminal record (he's the USC) for theft and also a parole violation. No problems at all with our case so far. Interview is next week.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

There's been posts and threads about this very topic. I myself have posted several times talking about how my husband petitioned me from prison. Usually, these threads only get a few replies and then they fall far down the list of threads, but they're there. :)

They'll look a little closer on bona fida evidence at the interview and the fact that the US petitioner's in prison will come up, but other than that, it's just like any other visajourney. It's obviously a different story if the crimes fall under AWA.

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

"For adjustment of status, you have to prove that you're in a marital union. USCIS interprets marital union as two people living together, so I think AOS will be very difficult with your husband in prison. You might want to talk to a good immigration lawyer"

You should be fine, I have a interview this month and asked for my fiance, two charges and one was a felony. (fleeting and allotting) As long as it isn't domestic or violent, which is what they will warn your fiance about during her interview, I think you are fine.

(They warn your fiance regarding your charges so come in clean. Also will give him or her rights regarding domestic violence.)
