Update :

So I've consulted an immigration attorney and he's taking care of things for me to have my application canceled with the USCIS and I was then told that I am a USC by birth and it doesn't matter whether my mom was present in the US 5 years before my birth , that was a wrong information in this thread. I'm gonna have to submit her birth certificate along with mine from Morocco and i called her to confirm that, and finally she cooperated since she didn't have to do anything but sing couple documents.

So yeah my lawyer told me that i'm gonna have a work visa basically to live and work until they finalize my application, he also stated that I'm gonna get the citizenship with no doubt.

This thread was a blessing and I am so freaking thankful for you guys.

Thank you !!! :joy::joy::joy::joy:

I would definitely double check on that 5-year physical presence requirement (I think it's only one year if you were born out-of-wedlock) because that's a requirement to be able to pass on citizenship to children born abroad, I'm surprised your lawyer didn't think it mattered because it does.

Read form N-600, it asks for all the time periods your USC parent spent in the US. If it doesn't matter why does the form ask for it. These would be good questions to ask your attorney. Make sure he's not taking you for a drive, promising you things that aren't true.

Also, what kind of work visa is your lawyer talking about? If you are a USC then by definition you cannot get any type of US visa.

He meant that i can work and stay in the US till the process ends (which i assumed is a work visa?), and i have asked him about the 5 years thing for my mom and he said college pics are enough for that and that it's not 5 years and that it was a wrong info, i'll check up with him later on, It's not like i have to pay him more anyways it's one fixed price ;)

Even if it's one year, pictures are not enough proof.

OK, so it's not that the physical presence requirement doesn't apply, it's that you can prove she fulfilled it. Make sure to get that N-600 filed ASAP because fees will increase on 23 December.

Good luck to you!
