OPs wife now states they have a date. Let's keep it real here. A k1 even when issued or hung up in AP can not be used to enter the US when the couple has married before leaving his country.

It's not crystal clear from your other thread, but have you gotten married? Apparently the reason for the K-1 denial was that the CO thought you were married.

The only way to remedy the situation in a case like this is to actually get married and file an I-130 for a spousal visa.

It is clear to me that they got married going by his post stating " we got married". Past tense. It appears OP is confused about the return process in Ghana thinking that they still have a chance to get the K1 approved but as I said Ghana has not returned it nor notified NVC and USCIS. That's what Ghana does, they keep the case collecting dust instead of returning it in a timely manner which leaves everyone confused including NVC and USCIS. OP genuinely thinks that even though they married he can still be issued the visa. I don't think there is willfull deceit. OP can't enter the country even if the visa would be approved now that they "got married."

I appreciate everyone's genuine concern, and I can see where the confusion has set in. Let me make this clear... we are on the correct NON FRAUDULENT track. We will update on our success. I'm very disgusted at the approach many of you have taken. I apologize for any information that may have seem to be misleading. While I will not speak for SHISU, I will say this every part of our journey is NOT up for discussion. What is between us is for our God to honor. What is for the Land we live In we still are in hot pursuit... and that would require a MARRIAGE LICENSE!!! Kindly keep your negativity away from us. Op, we're just trying to get an idea if you're married or not in order to help guide you in the correct way of dealing with this mess. I feel sorry for anyone having to deal with the Ghana embassy. I see people on here denied left and right for the smallest of reasons. Sometimes there doesn't seem to be an issue at all. I understand you don't want to share certain things,but in order to understand what is going on we do need to know a little about you.

It's also not country dependent that K1s are left to expire and CR1 are sent back to USCIS for NOIR/NOID. Ebunoluwa is knowledgeable in this area of immigration.

It's not uncommon for others to comment regardless of country origin. It's also impossible to discuss reasons for denial and your individual issues of the process without devulging some personal info.

OP should heed Ebonuluwa's warning. The K-1 was most likely denied like they previously thought, only the Consulate in Ghana has not told that to NVC/USCIS.

Instead of waiting and wasting time, they should marry and start the spousal visa process which they'll end up having to do anyway.

If they start now, it'll take a year from now.

If they spend 6 months on trying to figure out what's going on with the failed K-1, that just adds to the time they have to spend waiting to be together in the US.

When you asked for help in a forum and people ask for more info, I find it very strange that the important part of your

journey is not up for discussion and you talk about not wanting to throw your husband under the bus. What ?

You want to talk process and when you get the procedure laid out you get defensive because you don't like the answer.

No one even slightly suggested your love and union would be stopped. If further inquiries about your personal decisions

Yes, marriage requires a marriage license but if you had a traditional wedding only in preparation for the I-130

then it is obviously not enough to file a I-130.

Your husband said you married in preparation for filing the I-130 and logic assumes you do have a marriage license.

A traditional wedding is definitely seen as being "too married" for a K1 for Ghana, even if you

did not have it registered.

Married or not married, it sounds like your K1 will be returned and expire and there is nothing your lawyer can do to

over rule the CO's decision or change the entire procedure for a returned K1, except run to the bank with your money.

If your lawyer's advice was anything other than to contract a legal marriage and file an I-130, it won't benefit you at all.

Your definition of marriage is your business.

But the facts are that

1) K-1 was denied because the CO believed you were married

2) it doesn't matter if the CO was right or wrong, the only solution for a K-1 denial where the CO suspects marriage is to actually marry and file for a spousal visa

The reason for 2) is that you'll never be able to convince that CO or even another one that you are not married. They want to err on the side of caution so if they have the slightest suspicion you might be married, they'll deny you for that reason.

Actually getting married and filing for a spousal visa obviously overcomes that problem.

Look at the bright side: they think your relationship is genuine. That's the key here, many have problems proving their relationship is bona fide, especially at a hard Embassy like Ghana.

If your married your denied because you filed K1 you need to change refile to Cr1 , see Ms Ebulena post she's wise in this matter and Ghana.
