Dear all,

I appreciate if you can help me with this topic:

My fiancee in the US has filed for K-1 petition (I-129F form) and USCIS has confirmed the reception of the document on April 2016. A month and a half later my fiancee and I decided to split and stop the process. Her lawyer had sent a petition withdrawal letter which according to DHL reached the USCIS centre in California Laguna Niguel on June 2016. The petition is not yet approved nor withdrawn because when I refresh the USCIS website I still see the same case status as it was in April, that the petition was received and is under processing. Meanwhile two things came up:

1- I have a business event that I should attend in September.

2- I have met another girl from the US we met twice and currently we are in touch and the relationship seems to be going very well, and it can happen that in the future we may get engaged. She also knew about my previous petition and was very supportive.

Here are my questions:

1- I would like to apply soon to a B-1 visa, will it be rejected? Should I wait longer until petition withdrawal is confirmed?

2- In case my B-1 is rejected will it affect my future K-1 visa application with my second fiancee?

3- To avoid complications, is it better to apply only for second K-1 and avoid the B-1 application and not go to the business conference altogether (it is really bad)?

4- How long should I wait before applying for the second K-1 petition?

I am really thankful for your help.

The issuance of a tourist/visitor visa is very dependent on the visa interview. That being said, your previous interactions with USCIS will likely be topic of interest in your visitor visa interview. Be truthful and forthright. You will have to prove to the satisfaction of the US consular official at the interviewing US embassy/consulate, that you have significant ties to Germany such that will return to Germany after your US visit is completed. Such ties could include, property, house ownership, current stable employment, etc. Each visitor visa applicant is presumed to have immigration intent, and must prove that they are not trying to immigrate to the US. Due to your previous fiancee visa submission, you have already expressed immigration intent, you should expect extra scrutiny.

If you have redflags and no ties to the country of your citizenship can be denied of course, but k1 withdrawal shouldn't affect

it will be on your record definitely, for the CO only denial circumstances will matter

3- To avoid complications, is it better to apply only for second K-1 and avoid the B-1 application and not go to the business conference altogether (it is really bad)?

your hasty second application for k1 and short relationships with "other fiance" will be huge red flag

4- How long should I wait before applying for the second K-1 petition?

when you both will be ready for such commitment like marriage and will have all the supporting evidence of your genuine relationships

Are you citizen of France? Have you tried VWP before might be easier than yourist visa?
