Timeline

got my rfie in the mail today :(

They need :

- i-94 arrival/departure record and the passport page showing admission to the us.....Ive already send that

- Birth certificate translated in english

- I-864 instead of I-864w

the first 2 i don't have a problem with. but why do i need the i-864?

my ssa statement shows i have 35 quarters already

my husbands ssa statement shows he has 40 quarters already

now we have been married 4 1/2 years now and according to the instructions i can be credited by my husband.

Since we've been married i can be credited with the quarters that he earned, hence each year one will get 4 quarters for earnings.

So by my calculations we have ( 4 years x 4 quarters =16 quarters, since we've been married ) mine 35 +16 + his 40 = 91 quarters.

i know its confusing, but i dont understand why we have to file i-864 now and we dont have enough earnings according to the poverty guidelines, because my husband is/was self employed and now disabled

i dont know what to do now, should i resent the I -864w again with explanation and maybe a certified ss statement ?

And they didnt even ask for the i-693

i know this is an unusual circumstance, but any help would be appreciated

June 23, 2016 - Mailed I-130, I-864w, I-485, I-765, I-131

June 24, 2016 - package delivered to Chicago Lockbox via Priority Express mail, Recieved and signed by R. Mercado ( Day 0)

June 28th, 2016 - Money-orders cashed ( Day 4)

July 4th, 2016 - NOA Received by text (x4 ) and email (x4) at 11:44 PM

case accepted and routed to the USCIS National Benefits Center for processing ( Day 10)

July 7th, 2016 - Hardcopy Received NOA x 4 ( Day 13)

July 15th, 2016 - Received Biometrics letter, Appointment set for July 29th ( Day 21)

July 26th, 2016 - All 4 receipt numbers are working on the uscis mycase now ( Day 32)

July 28th, 2016 - Biometrics walk in Successful ! at 12:45 and was done at 01:10 (Day 34 )

Aug 5th, 2016 - Case update online ( RFIE-I-485 , Rejected form I-864w and wanted form I-864 instead ) (Day 42 ) put on hold

Aug 11th, 2016 - RFIE received in the mail

Sep 27th, 2016 - Send Response to RFIE at 9:18 a.m.

Sep 28th, 2016 - Response to RFIE Received at Lee`s Summit,MO 64002 at 9:29 a.m. signed by M. Sievers

Sep 29th, 2016 - Case Updated online to Response to RFE was received at 1:20 p.m. ( Day 0 )

Oct 14th,2016 - EAD ( I-765 ) Case updated online to" Case was Approved " and " we ordered your new card "( Day 15 )

Oct 14th,2016 - AP ( I-131 ) Case updated online to " Case was Approved " ( Day 15 )

Oct 20th,2016 - EAD Approval hardcopy received ( Day 21 )

Oct 20th,2016 - AP Approval Hardcopy received ( Day 21 )

Oct 20th,2016 - in the Mail a Notice to Applicant letter " A Completed and signed I-693 was not submitted ",Submit a valid,

completed and signed I-693 at a later date( at Interviw or if no interview you will receive a RFE for the form ) ( Day 21 )

Oct 28th,2016 - Update online " EAD card was mailed to me " ( Day 29 )

Nov. 1st, 2016 - Received Text Message and Email from MYUSPS, my EAD/AP Card will be Delivered tomorrow ( Day 33 )

Nov. 1st, 2016 - I-485 case updated online to " Interview is Scheduled " for 12/01/2016 ( Day 33 )

Nov. 1st, 2016 - EAD/AP Combo Card in hand at 6:07 PM ( Day 33 from response to RFIE Received )( Day 130 from filling for AOS )

Nov. 4th 2016 - Received Interview letter in the mail ( Day 36 )

Nov. 8th 2016 - Applied to change my name on SSN ( Day 40 )

Nov. 22nd 2016 - Verification from DHS for SSN cleared ( Day 54 )

Nov. 23rd 2016 - Applied for State ID at the BMV ( Day 55 )

Nov. 28th 2016 - Received SSC in the mail ( Day 60 )

Dec. 1st, 2016 - Greencard Approved on the Spot ( Day 160 )

Dec. 5th 2016 - Case Status for I-485 changed to "Approved" post dated Dec. 1st

Dec. 5th 2016 - Case Status for I-130 changed to " Approved" post dated Dec. 1st

Dec. 5th 2016 - Welcome letter and I-130 Approval letter in the mail , both post stamp Dec. 2nd

Dec. 6th 2016 - Case Status for I-485 updated to " Card was mailed to me"

Dec. 7th 2016 - Update on my Green Card, Text from MyUSPS " Card was Picked up", expected delivery date 12/10

Apr 16, 2021:  Interview in Portland, OR. Refused entry to USCIS office due to have traveled abroad in the past 10 days. No interview. However, a few hours after refusal, received notice of approval and card produced!  

Apr 20, 2021:  Card mailed! "On April 20, 2021, we mailed your new card for your Form I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE"

Got an update today.

My I-485 was approved. Status on the I-140 wasn't changed though, so hopefully wasn't an error. I will see what my attorney thinks.

There we go. I-140 updated to approved also.

So it took just over two months (June 15th to today) for my concurrent filed application to be approved. I probably got lucky with the retrogression of EB2 cases.

I have submitted my package on June 28 and went in for the Biometric appointment on July 28, and after that I haven't received anything regarding my case. I am just wondering if I should start looking for a job now? I read that it is possible to send the EAD Expedite Request if I got an offer, does anyone have experience with this? THANKS IN ADVANCE! AOS Timeline [Husband is the USC, got married to foreign wife on May 31, 2016 (who was on F1) we both share this account]

June 25, 2016: AOS Package sent with EAD and AP request

June 30, 2016: Checks cashed

July 02, 2016: NOAs Received in mail (they have misspell my wife's name on 2 of the 4 letters they sent us)

July 04, 2016: Electronic NOA1s Received + USCIS online case status shown as "case received"

July 18, 2016: Received biometrics appointment letter in mail (scheduled July 28)

July 28, 2016: Biometrics appointment taken as scheduled, also have my name corrected at the center

Sep 09, 2016: Submitted Service Request since it has passed the 75 day time mark

Sep 12, 2016: Received Service Request Response: case is within our current processing time

Sep 12, 2016: AOS status changed to "interview ready to be scheduled" . EAD & AP case status remain unchanged.

Sep 20, 2016: EAD status changed to ready to deliver, AP case status remain unchanged.

Oct 04, 2016: AP case status remain unchanged but EAD and AP combo card was received in mailbox.

My advice would be to start looking for a new job, and negotiate a start date of Monday October 3rd, which is the Monday after the 90 day mark of you application (September 26th) was received. If the date they received it is different, adjust accordingly. This will give a very high probability of obtaining your EAD card before your start date.

If you have not received your EAD approval by 75 days (September 11th), put in a case inquiry to verify if its been assigned to an immigration officer. If you have a job offer on hand by that time (or after without your EAD), call and put in an expedite request stating financial loss to yourself and provide them with a copy of your job offer.

They wont accept a request to expedite before 75 days have passed, and I wouldn't try to use an expedite request to start working before the 90 day mark since the IO might think that its your own fault for not planning, and your new employer might get annoyed to.

So go ahead and start looking for a job, and relax for another two weeks before you start taking action.
