Hi Sir, I am a naturalized USC thru marriage. When I was a teen ager I had a son and the father of son family took him away. Later I got married and moved here in United States. I have a 7yr old daughter with my current marriage. When I filed my N400 I never listed him Since I had no information about him. He is 20yrs old now and I found him last year. Can I still petition for him? I had been supporting him last one year.

I have a proof of birth certificate.

Please help. We only have 6 months left before he turns 21.

Thanks a ton in advance.

Wrong.

She is his mother. She can file for her son. He is considered a child since he is under 21 and is unmarried.

Hi,

File for your son before his 21st birthday. It will take about a year for him to get an immigration visa.

Best of luck.

Thank you. He was born when I was 19 out of wed lock. I was afraid to list him as my son during my N400 citizenship process. I do agree that there may be a DNA test required. Which is perfectly fine since I'm his mom.

I badly wanted to file now since he has all the paper work. My family also supporting to bring him here. I will file them in 2 days.

Do I also send them the financial statement for the proof of supporting? I have that.

I don't have a pics of him and I to send it.

Uscis.gov website says I can also file for K-4 visa (Form I-129F) along with I-130 so he can come and live and go to school. Is that true?

Please I request you all experts to help me. So he can see me and have a family here.

Thank you Anitafeliz. I sincerely appreciate your time and help. God will bless you abundantly.

You know how this feels to see your child who you haven't had a chance to rise pause and live. I'm really hoping and praying to have my baby join here with his little sister and step Dad.

Yes. His Birth record has my name on it.

Will they deny becas I haven't listed him in my N-400 process?

Raise and live with.

Do I also send them the financial statement for the proof of supporting? I have that. No. Do not send the I-864 Affidavit of Support with the I-130. Send the I-864 when requested by the NVC. Do not send it to USCIS.

I don't have a pics of him and I to send it.

Uscis.gov website says I can also file for K-4 visa (Form I-129F) along with I-130 so he can come and live and go to school. Is that true? No. You are misunderstanding the purpose of the K-4. You can not apply for a K-4. The IR-2 visa will take about a year. There is nothing you can do to speed this up.

Please I request you all experts to help me. So he can see me and have a family here.

Thank you so much. I'm grateful.

Will I have an interview before they approve I-130 to clarify the reason why I didn't list his name in Citizenship process?

They just ask whatever needed for this application? Since my N-400 is closed 4 yrs ago.

Given that you failed to list him on previous applications when asked to do so (under penalty of perjury), expect this to be looked into.
