Chinese Communist Party Affiliation

Hello,

This is my first post, and I am quite concerned over what I have read.

I have reached the final portion of preparing my K1 documents in order to get a visa for my finance living in China. However, she is a member of the communist party, and I have read that this bars her from getting the visa. She received a student visa for America in the past without any problems, but of course this is a non-immigrant visa, so maybe its different? Being a part of the party amounts to sending in about $20 a year to them, and nothing more, but it seems like this affiliation may make things impossible (guess McCarthy is alive and well). Now I am freaking out and need some current advice.

Is it true that this will destroy all of my plans? If she formally resigns now, will that even help? What do I do now?

I would really appreciate some help on this, thanks.

It's okay. Under the best of conditions, the visa process can be daunting. Then when you throw into it CCP membership, you enter into another realm and a major complicating factor. I would suggest that you look through some of the pages in the regional forum. There have been several members that have had to deal with that issue.

Here is the specific section of the INA from the State Dept FAM that you will be dealing with: http://www.state.gov/documents/organization/86972.pdf

Good luck on your immigration journey.

An EXCELLENT write-up from someone a few years back, but still applicable. Well worth the read

We just received our K1 and it included CCP membership. We filed our 129f in Feb, she interviewed in early July - the CCP added about 6 weeks extra review time and about 2-3 weeks of that was sending it on a roundtrip to Homeland Security and back to GZ. If you really researched this topic on the web and came back with " ... this bars her from getting the visa" you might have other problems understanding how to succesfully complete the K1 visa process altogether. I wish you luck. But, people, you really gotta study the VJ how-to's here and be sure you cover every detail.

If you did your app right, she will receive a paper after the interview with instructions on how to submit more information about her party membership. She will answer some questions and submit the answers online. The consulate knows what to do with it. Good luck!
