My husband applied for a tourist visa to the US back in 2012 and was denied(no travel history). Within 2 months he got an invitation to a conference and got denied again for the same reason.We were just dating at the time. We traveled all over the world together and in 2014 he was granted a US tourist visa. He came to visit twice, last time being already after the engagement.

I just read a story that a woman's visa was denied at the consulate after I-130 was approved because she had denials for B1 and F1 student visas before.

I am worried sh*tless.

I try to calm myself down that if my husband wanted to illegally stay in the US, he had a chance and he would have done it last year after the engagement... but he didn't. Instead we spent time and money to meet outside of the US. :bonk:

Does anyone have any input or experience with previous tourist visa denials? We did DCF in Moscow and our I-130 was approved pretty much on the spot (but that woman's one was too!! AAAA!!! :huh2: )

December 2010 - ex-husband got crazy

November 2012 - divorced!!

November 28 - BIO & InfoPass to submit a divorce decree

December 2012 - CGC expires

May 3 2013 - RFE received, asked for a divorce decree (haha) and address clarification + more evidence

July 6 2013 - RFE mailed and received

September 2013 - InfoPass, passport stamped to extend my status

November 2013 - Finally an interview is scheduled
December 12 2013 - Interview. Approved without any questions, passport stamped. Same officer who did my initial interview (I was told "I saw it coming, don't give up on love" :) )

December 27 2013 - Card received, too bad I was overseas

January 2014 US entry, special screening, but admitted instantly once I got to speak to the officer. It's a standard procedure if no valid GC on hand.

July 2015 - MARRIED in Russia

N-400

October 2015 - N-400 sent

February 2016 - interview and test

March 2015: USC!

DCF for my husband

April 2016: InfoPass to file I-130 in Moscow, approved on the same day.

May 2016: DS-260 interview - AP for "dangerous" work field

July 2016: visa issued! 59 days in AP.

May 2018: filed I-751 

June 2018: 18 months extension received

I traveled all over the world in the meantime, no problems with visas and entries, occasionally some explaining and more documents to haul around.

I would think he's fine because he was granted a tourist visa after... No? :huh2:

Where did you see this, I have never seen it happen.

Maybe that woman had lied on previous applications? ... Don't know if that could be it then otherwise I haven't seen any get denied just because of denied visitor visa

That would be a valid reason to deny her another visa, regardless of type. Sponsor not making enough, not showing proof of on going relationship, the list is long on why someone could be denied a CR-1 visa. But there are no denials because a previous tourist visa was denied, there is more to that story that was not told.

That would be a valid reason to deny her another visa, regardless of type. Sponsor not making enough, not showing proof of on going relationship, the list is long on why someone could be denied a CR-1 visa. But there are no denials because a previous tourist visa was denied, there is more to that story that was not told.

Yeah but if was only for a denied visitor visa then I can only think of that she must have lied before.

But yeah I also would think there would be more to that story.

Why are you putting the wagon before the horse?You have no idea what her case in tails all you can do is wait it out because if he's already entered on a tourist visa and his denial was prior to...what ever the issue was prior was removed could have been as easy as he had no ties at home and he was a skip risk.

If you compare your journey to others you will go mad :jest:

I mean I wouldn't be so scared I would find out :reading: on the subject someone stated a prior denial of entry isn't s a reason for approval of Fiancee or spousal visa and there's more to her story.

From what I gathered she applied for B1, got denied. Then applied for F1 and got denied. Finally she married a USC, lived together with him in Moscow, got I-130 approved,went to the interview together... and then stuck in AP resulting in the intent to deny. Their relationship may very well be real, but it just looked bad with all the visas.

I am worried because, first of all, all I can think about these days is our immigration process. I think about it when I'm walking, driving, showering, playing with the dog and even working. It's crazy.

Second, I am worried because what if they think he lied on his applications? He didn't mention me on them - he said he is going to visit major cities as a tourist. Which he did, and we have photos from there, but then he went to visit me too.

Third, I know of a person who had a tourist visa, visited a couple times, then went to apply again and got denied. Then they applied for an IR-1, same thing - DCF Moscow, - got approved, but the computer system was down at the moment. When it came back up, consul said "oh, you had a denial! good for you I didn't see it before", which means that denial would have been a bad thing.

Finally, I am worried because I am calculating every possibility at every step. What if they keep his passport for AP for 4 months and we miss our conference in September? How are we going to meet if he doesn't have his passport? etc, etc, etc. See the level of overthinking? lol))

Your husband was denied a visitors visa twice in the past, then a couple of years later he was approved for a visitors visa and have visited the US twice without overstaying but you now worry your spousal visa will be denied????

First of all, a denied visitors visa will not impact your spousal visa. Lots of people with spouses in the US have been denied visitors visas or VWP entry, mainly because they've shown immigration intent and need to get an immigration visa to enter the US.

Secondly, the US have since approved your husband's visitors visa so that already shows that the previous visa denials don't matter. What will matter is you proving you're in a bona fida relationship.

You worry way too much, and this is coming from a woman who used to worry about everything. :D There is more to that story about the Russian woman then just a denied visitors visa. If thousands of people say it's X and one person comes and says it's Y, it's best to take whatever that one person says with a pinch of salt.

Tourist visas are very hard to get from some countries because they don't believe the applicant will return to their home country. It doesn't take lying to get denied, it only takes the inability to over come the assumption they will over stay. For this person to get denied a CR-1 afterwards, much more went on that may or may not have had anything to do with the tourist visa.
