My cousin is about to send his petition to roc on his greencard.he was once involved in helping someone pick a package which turned out to be fraud. He wasnt charged by the cops but his fingerprints were taken at the station.Should he state that and get a report from the station to add and send with his petition next month?

If you mean by picked up, that he was arrested, and taking finger prints sure sounds like it, then yes.

On the ROC paperwork there is a question that specifically asks if you have ever been arrested or detained etc. by the police. He will have to answer yes to that question but if no charges were filed you have to submit paperwork stating that and explain the situation. It is all explained in the instructions for the document.

Item number 20 on I-751 asks:

Have you ever been arrested, detained, charged, indicted, fined, or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime which you were not arrested in the United States or abroad?

The instructions for I-751 elaborate on the question with the following:

If you have ever been arrested or detained by any law enforcement officer for any reason, either in the United States or abroad, and no charges were filed, submit an original official statement by the arresting agency or applicable court order confirming that no charges were filed.

He should answer "yes" to item 20 and attach the relevant documents.

There shouldn't be an issue if no charges were filed, but it is best to be forthcoming about the arrest. You may also want to explore the possibility of a consultation with an immigration attorney to be safe. Good luck!

Wonder what he actually did.

A friend of mine almost got in trouble for something like. Some former acquaintances used stolen credit cards to shop online, and ship to my friend's address. The post office got suspicious and called my friend to come and collect his package from the post office. My friend declined and told them that he wasn't expecting any package and that could be a mistake. He probably would have been arrested had he shown up.

So that could be the case.

absolutely ridiculous - if you weren't charged and just detained without them even taking your name down, which could happen just being in the wrong place at the wrong time  - you would have to be retarded to put that down lol
