A B2 visa wont be issued to have a baby either you petition your wife (which wont be fast enough) or apply for

an extension when it close to her 90 expiration date here Make sure medical bills are paid up, and dad if you

live in rhe US not more than 5 yrs ago (I think) you could pass citizenship automatically to the baby

I don't understand- you want to go through all this hassle to have a better water birth for your child but will subject him/her to a long flight back to Spain when they're what, a few weeks old? I would think THAT would be way more stressful and painful for such a young baby, no?

Not to mention the other passengers lol

Have you checked that this specific birth center accepts said insurance? Or is it something that you pay in cash & get reimbursed later?

Also, be prepared that there is the possibility that you'll need to transfer to a hospital, in which case it will be pricey. (In case you need to pay first & your insurance reimburses you.)

I'm not trying to be nosey. But you definitely need to show that you can afford a birth in the US, that you are prepared for any eventuality (e.g. Hospital, c-section, etc).

About applying for a B1 visa: your wife needs to show strong ties to Spain, in this specific case maybe she should present YOUR strong ties to Spain, too... I don't see it very likely that she would be approved, but it's possible. I'm not sure it's worth risking her VWP privileges.

You need to understand that EVERY tourist visa applicant is assumed to have immigrant intent, by law. Couple that with a USC husband & a baby on the way, plus she's from a VWP country, not the best odds at all.

The CO is not looking for reasons your wife needs to go to the US. They don't care about that. They are looking if she's likely to come back. From an outside prospective it does not really look like that.

We need to check whether the birth center accepts it - I kind of don't expect them to. We're planning on paying the birth center itself out of pocket. Their price is fixed and known in advance. The insurance would be to cover possible eventualities like you mentioned. As part of our application, we'd provide proof of several tens of thousands of USD, plus the insurance. And we can prove ties in Spain - my business will be here, my wife's father lives here, rental contract, official documents from various Spanish authorities. I don't know what else they could want...?

Anyway, I'm getting so many conflicting answers on here. If there's a reasonable chance we could get rejected then we'll look for another way to go about it.

That's why we want to stay longer than the 90 days under VWP, so we're not rushing anything. And potentially much more stressful for both mother and child to give birth in a rushed "production line" hospital than taking a few hours' flight.

Case in point. My question was only this: given that USCIS make the rules and that they "don't give a toss" about anything else, and assuming that you know more about this topic than I do - do you think they will accept our application, or not?

We do not know. They may accept it you might get the visa. But you could also get to the USA after a long tiresome flight to be told by cpb at point of entry "nope, sorry, turn around" and be out on the next flight too
