Hey, great tip! just did it and they finally tranfered me to the tier 2, they will give me a call back in 69 minutes aka 3 hours hahah

Thanks a lot!

This is what I do... I tell them I need an update on my background check and cause they can't check it they always transfer me to tier 2.. Tier 2 will tell you if your cleared or not... Background check do not delay the progress of your I-485 but will put your EAD at a stand still

Glad it worked for someone else... Even if you already know the status of your background check I would still use that excuse anyway cause they can't see the information so they have no choice but to transfer you to a tier 2 and they don't relay the reason why your want to talk to a tier 2 officer when you're transfered Edited by Moslund

So update:

Tier 2 just called me back (9 pm), he said they have offices in the West coast and East coast so you can get a call back late night.

I asked about my EAD and he said that unfortunately they were delayed and EADs were taking anywhere from 90 to 120 days to get approved. :crying:

He offered to put a service request on my case, but then noticed that I had done it online already (on June 24th). He mentioned that I should get an answer on my service request by July 9th (day 95). If I don't hear anything by July 9th or if I don't feel that their answer was satisfactory I can call back and put an expedite request on my case. But I must provide evidences on why my case should be expedite...

Anyways, we are back at the waiting game... he finish saying that I needed a bottle of wine to relax (I guess my anxiety is showing).

:clock: Good luck everyone.

quick question. Does everyone who got a RFIE for the AOS got their EAD delayed too? Or is there someone who still got the EAD/AP card within the 90 days even with a RFIE on the other case?

I am not sure about your timeline, but I do have an RFE that came around day 55-57 days. I spoke to Tier-2 officer on day 78, just asked the status of my case and the next day status changed to Case was approved. Once you get over day 75 just give them a call, I think it just helps your file come up in the stack.

25th March'2016- Sent out the application via UPS to Chicago.

29th March'2016- Package received. (day1)

4th April'2016- Received 4 Text SMSs and 4 E-mails from the USCIS notifying my case has been received and routed to National Benefits Center for Processing. (day 6)

6th June'2016- Address change request was completed.(day 61)

11th June'2016- Letter of Address change confirmation was received. (day 66)

23rd June'2016- Called USCIS asked to spoke a Tier 2 officer was called back on the third attempt after 8 hours and spoke about confirmation of address change. (day 78)

thanks. seems from all I read here that I should be able to call at the 75 day mark to make sure it stays on track!

That is a complete and utter lie on there part!!! They can't check background check but teir 2 can... Even when you call the FBI the answer service states if you need an update on your background check to call Uscis for status updates on your finger print and name check... And the 3 times I've called regarding my background check which is STILL pending btw teir 2 was able to tell me when they recieved it and what status it was in... Each time they were able to confirm the date the FBI recieved my info and each time stated I was still waiting to be cleared... I hate when you call them and they don't know what there talking about and refuse to transfer you!!! Edited by Moslund
