I am not sure if she is required to change her status on her ID, and of course she knows she is married.

Bottom line, we will have to see if it becomes an issue.

When you get married in Venezuela you have to change your marital status in your ID card or cedula, and if you keep using the old one taking advantage of the "single" status is against the law! is not a big deal until you use it to avoid marital duties.

I think you are worry about nothing. When she got her tourist visa denied and she got that paper, it didn't specifically say "you got denied because you are not single". Everybody knows that get a denied tourist visa is SUPER easy even if you have everything they are requesting.

So if she apply all by herself she probably didn't have enough proves to show her ties to Venezuela (getting divorce, young, probably no assets or properties etc) so I think that might be the right readon why she got denied.

Having a denied tourist visa is not an issue. I come from caracas venezuela as well I got a denied tourist visa like 2 years before applying for my k1 visa and it wasn't even brought up during the interview. A friend of mine also got an approved k1 visa a few months ago after 2 years in a row trying to get a tourist visa. It wasn't even mentioned during the interview.

So don't worry! Just make sure to keep your ducks in a row.

Is not against the law, until you use it to represent yourself as a single person in an official act, when in fact, you are married! I know sometimes people lie about their marital status to get a tourist visa but when the same person applies for a k1 in the same consulate, there is a big chance of someone asking for dissimilar information! the k1 is all about backgrounds checking.

This whole situation is not motive to get a rejection, but it could subtract some credibility from your fiancee if they find out she lied the first time.

Well it was more like she did not feel like a married person, it was a long time ago and they did not even lived together, and she just went by her cedula status, i know its clear what married and single is, anyways nothing we can do about it, just hope it does not become an issue in the future, thank you all by the way for all the input and advice

Best hope is that the Consulate considers the lie not material, how you would explain saying you are single when you are married I have no idea.

Hello everyone, I have a question in regards to a previously denied visa for my girlfriend. She applied for a B1 tourist visa in Caracas a few months ago, she was denied and handed a paper explaining the reason is under section 214(b) which from what i read is one of the most common denials, when she applied she put herself as single because that is how it shows in her cedula ( ID) she has been married for a few year but never even lived with her husband, since it was a young and dumb move to get married at such a young age, anyway they never lived together, after such she met her former partner and father of her baby, they never got married and lived together for a few years. I am planning to petition her under a K-1 Visa, now my question is if it will be a problem when they review her case at the embassy and see that a previous visa was denied (214b) failure to convince the consular officer that she will return to her country, and see that she put herself as single instead of married? she is in the process of divorcing and the divorce should be ready in about a week or two, I am kind of worried they go back to her previous denial and question why she put herself as single instead of married, and present a problem for my petition for a K-1 Visa.

Not sure how tough US Consul in your country. 3 times I got denied in Tourist visa. When I applied for the 4th time, I was granted because I had proved to the Consul my STRONG TIES in my country where I currently live. 2 times got denied because the Consul said lack of ties, my relative in US invited me. 3rd time was denied because the one who is inviting me is my boyfriend, the consul also advised me to apply K1 fiancé visa if our relationship become deeper and serious. 4th time, a friend of mine invited me to visit US and Boommm - GRANTED! During that time I was enrolled in the University for 5 months or 6 months I guess, also I got promoted in my job, salary increased..that's why the CO granted me a 10 year multiple visa entry. Then last year, my fiancé proposed to me and we applied for K1 visa and finally we got approved and I'm going to see him very soon :) Just always be HONEST to Consul. If your gf will have interview again for K1 visa, IF only asked by the CO her marital status they she can explained her reason why she said she was single even if technically she's married. But I don't think it's a big issue. As long as your relationship with your gf is BONAFIDE and you can prove that to USCIS & US Consul, there will be No problem with your I-129F application.

She likely wasn't denied for misrepresentation, or the reason would have been stated, probably because they didn't know she was married. But misrepresentation could still be discovered when checking records and statements in review for the current visa application, for which she would need to be ready for an explanation as to why she stated she was single. One thing NOT to do is to continue to cover up her previous marriage.

I do not think that is the case here, actually to the contrary she stated single as that is her status on her government ID, but then again I am no expert on the subject

I don't think it matters what her I'd says, she is married! FYI when you apply for any type of visa it stays in the system whether she applied today and lied or 5 years ago and lied, they will see all her pass applications and either question her about why she lied or denie her for lying either way

It's in the system so it probably will come up. Whether or not the CO accepts her explanation on why she said she was single when she was actually married, well that's hard to say if they'll see it as immaterial or not.

Well for what i read it should not be considered material misrepresentation, her status as single instead of married should not be a determining fact to issue her a tourist visa, it will be on a k-1 but not on a tourist visa, at the end it will be at the discretion of the CO.
