B2 Denial, K1 approval, Drug Test Fail, A Year of Drug Tests, Starting over again.

My fiance and I started our visa process in October 2013 with a B2 visa which was denied because he couldn't prove he had strong enough ties to his country. We then applied for a K1 immediately afterwards. After a very long wait in which California and the Philippines were getting approvals in literally days and we waited nearly a year, we were finally approved and waited our turn to interview at the embassy. Finally interviewed at the embassy and found out we'd have to wait yet another year because a failed drug test due to weed. We did all the required interviews, drug test, even paid $500 for a new physical to be told one day after submitting the physical the petition expired and could not extended an with the current medical exam we had six months to complete the process again.

Moral of the story, if you have a hiccup in your petition, just file another petition. Don't wait another year and then be forced to wait yet another year like we will have to.

Drug use is not a hiccup.. If you fill next petition straight away it will be denied too, because drug bans are for certain amount of time.. Plus sorry but drug use is one of biggest no no to be approved, so you can blame only yourselfs (or him) for a long wait..

Federal government, which you are dealing with in the immigration process, says it is illegal then you abide by their rules - failing the drug test wasn't a hiccup it was your fiancés mistake. You say directly in the quote above not to wait the year before filing.

I know a lot of people who have been in a similar situation have kept in regular contact with the embassy asking them to keep the petition open which they can do at their discretion.

The point is that petition eventually will expire while you on drug ban, what's so hard to understand here?? Starting new petition just to have process going is not an option, actually it shouldn't even be approved because of the drug use and ban. I guess you thinking it's good to have petition going because when ban is over you can carry on with already again started petition... So your advice to start next petition straight away doesn't have any real arguments and is misleading, and I was commenting only this part, not all post, which has no sense for me
