Timeline

Hi, i came into the USA on a k1, got married within 90 days and submitted AOS. This has been denied as i-693 not given in(impossible to get a dr to sign off on medical and vaccinations received in the uk. Have had all vaccinations in the uk ds-3025 not ticked at bottom as complete, apparently uk dr does not do that). At AOS was given Rfe just vaccinations only on I693. Sent in letter asking what we shoukd do as nobdr will just do that.... Recieved decision back as denied!

Now, should we do I290b open the case back up, do a full medical submit i693 with i290b?

Whilst this is all happening am i allowed to stay in the country as my k1 has expired (before my AOS interview)

Someone can correct me if im wrong, but the visa is a single entry visa so it was gone the moment you entered the country. You legally married within the 90 days so that's good. You still have to get the AOS done but I don't think you have to leave.

But if im wrong someone jump in please.

I fail to understand why you did not do a full medical upon receiving the rfe, not finding a Dr to sign off on the UK medical does not preclude you from getting a full medical at around 150$ depend on where you are. You took a chance but now you complicate your life. I am sure you can refile but it has to include everything including a full medical and AOS fees all over again.

An appeal will not be successful since you were properly denied.

Re-file your I-485 (paying the filing fee again) and this time get a full I-693 medical done as part of the process. You may wish to wait on having the medical done until you are RFE'd for it or are given an interview; that way you minimise the chance your I-693 will expire before USCIS adjudicate your I-485.

For what it's worth, I obtained a typed copy of my childhood vaccinations from my doctor's office in the UK and it was accepted by the civil-surgeon I saw here without issue.

Many civil surgeons will do just the vaccinations portion that a K-1 needs. There is a whole, years ongoing thread here in the AOS about finding one > http://www.visajourney.com/forums/topic/231026-civil-surgeons-who-dont-rip-you-off/page-15

All that said, if you could not find one after calling around to many, even those that you would have to drive a couple hours to get to, then you should have just done the full medical again with the cheapest civil surgeon you find. You needed to satisfy the RFE in order to get your green card.

I don't get why you didn't just get a new medical done here in the US or why you sent in a letter asking them what to send instead of at least calling USCIS or making and Infopass....

You need to re-file AOS and you have to find a civil surgeon and redo your medical.

I agree the majority of the posters. Like many things in this process, results vary especially related to medical requirements for the AOS after a K1. As far a I know, you can stay in the country and refile the AOS along with the filing fees and get a full medical. We did that for my wife when we filed since the nearest CS (only 3 miles from our home) would not transcribe the 3025, so we did the full medical along with missing vaccinations as it seemed easier than shopping around and finding a different CS and driving a much further distance (approximately $130).
