Confused about NOIR and AP status

Dwheels76, I got my NOIR letter today and all what the CO mentioned as reason for the denial of the visa was not that right, Anyway I'm collecting some more evidences to send it the USCIS included envelope, but I need you to help with some ideas about what to be included too, Thanks

I'm not dwheels 76, but I can tell you we also received our NOIR, I returned my rebuttal with photos before and after marriage Skype records, text messages, letters from family and friends verifying that we have a bona fide marriage, also a bank letter stating that my husband could not being on my checking account because he dors not have a social or immigrated, I also included my will with my husband as beneficiary and also a five-page letter from myself, i answered what they wanted, they recieved it june 17 and i havent recieved a decision yet, only they are reviewing our RFE

robinanis thank you, we are also gathering the documents as much as we can. so do we still add pictures they already have? I live here and my wife live overseas. About skype we don't talk on skype we use whatsapp ,will that work? how can I print our conversation on whatsapp?...About any kind of Insurance can I add her even she is not here in the US?

First you cant put her on ins, but pics of when you visited with the family also, and passport stamps when you went, or itinerary, i had to screen shot my text msgs and where it shows more than 2,250 msgs. We skype and fb msg, fb video. I screenshot it all then printed them off

You need to e going over each denial point and address each with evidence. Whether its pictures, affidavits, communication. You submit for each point.

I have always told people make a cover sheet fr each listed denial and focus on that item and get your evidence.H

Having insurance and accounts together when you don't live together doesn't impress the CO's focus on the points mentioned in the letter.

Of course you send back. I believe their letter says to please put letter on top of your evidence. Just sending the documents like how will they know what to do with it.

Hi everybody,

My case was under AP for 8 months when it was returned back to NVC. It stayed at NVC for 1 week and sent to USCIS. All this I know because I have been calling NVC almost everyday. I involved my congressman and they will send inquiry to USCIS. Up to this point I just know it was sent back for adjudication (whatever that means). We have been thinking for my husband to move to my Parents Country, where we would be only 2 hours away. This will help with bonafide, if that is the case, but kind of scary when we dont really know the reason why it was returned. When should we expect letter? Would it stay the reason why it was returned?

Yes, the NOID/NOIR letter will state the reason for the visa refusal and you will have 30 days to respond with evidence

to overcome the reason. After USCIS has received the case back it can take several more months for them to adjudicate/review

it before you receive such letter. If they are satisfied with your response they send it back to the embassy with recommendation to approve.

The whole process can take a year from return of your case to another interview.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Of course you send back. I believe their letter says to please put letter on top of your evidence. Just sending the documents like how will they know what to do with it.

Send the letter.

dwheels76 thanks for your advise, although their letter did not say that but your explanation make sense, so I will make a copy and send the original of 3 pages. 2nd Question: The return envelope they included in their letter is too small for the documents I'm sending ,so can I use my own larger envelope to them?

i just waited my 180 days like they told me and nothing not NOIR or reaffirmed i feel like crying, I don't have a passport from Cuba to go visit him and when I re-apply they told me that is taking 6 months to receive it. it looks like everything that we try to do is failing apart. call again today and put a ticket and they said that i need to wait until August 27 for a response. :cry::cry::cry:
