Confused about NOIR and AP status

Ebunoluwa thank you , The 221g says: " Dear Petitioner, We are unable to issue a visa in the above mentioned case because the applicant has been found ineligible under section 221(g) of the immigration and Nationality Act (INA)..............We will return the above case file to the NVC, which will then transfer the case to the USCIS.....

I can not write all what is in that white paper.

So now can I call them? and what is the number to call ?Or should I wait for the USCIS to contact me....I'm desperate

Nyala62 ,hi bro is me trustG. I couldn't recollect my psw so I open a new vj acct with different I'd. I and my husband are going through the same thing, Sept 30 2015 we went to the interview together, the lady was so mean, she didn't even go through our document, frown her face like she has problem with us, my husband answered all the questions, I can hear them because I was sitting right behind him. After the interview, she asked how long I was staying and he replied her and schedule him to come back when I leave ,he went back on that day Oct 26, she schedule him again in November, he went again in November 17 ,and she wasn't there, but left a note for my husband that, we don't have strong relationship, senator Casey office contact them, she said our marriage is a sham, I cried my head off, but my husband was rather calm and told me to let's have patient. Right now next month will be our 180 days waiting period, so I'm going to make an info pass appointment to go and talk to someone in the office, because I'm leaving in December God willing to go to Ghana for our second year anniversary. Let's keep praying nothing too hard for God.

Your case is not in AP checks (even though your online ceac says AP) but was said to be returned and you have to wait about a year. I mentioned before the steps that will happen for you with the NOID

dwheels76 ,Ebunoluwa and other VJ members, what can someone do next when the NOIR appeal is dismissed? Is it better to refile or appeal the decision of the USCIS to dismiss the case? PLEASE HELP ME

I don't know any details of your case and suggest you consult an immigration attorney.

You need to post the NOID requests, the CO's findings and what exactly your response was.

Then you must overcome the reason USCIS did not reaffirm your case.

That requires an understanding of what exactly went wrong, fixing it and then proceed with whatever meets the criteria.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

What do you mean dismissed? Did you get a NOIR letter and you responded b answering all the denial post and you got denied?

Need a little more details here. Just to let you know just refiling doesn't fix anything if there are issues. And appeal how did USCIS make a mistake. You would have to show that.

dwheels76 ,Yes I got a NOIR and responded by addressing all the issues raised by the CO in Ghana, I also attached more proofs even with a sworn affidavits from her father and brothers , more photos receipts of remittances but this people still dismissed my RFE. That is why I need to know the best way forward
