I am Canadian and will be applying for my mother In-law and sister In-law that are currently here in Canada visiting us. From their home country Guatemala, We plan to go on a road trip from Canada to Nashville My mother in law has 5 Grand children living there that she has never met because she does not have a visa.

My sister in law is currently(In Canada) on a one year Canadian study visa to Study and learn English, She has been here 2 months so far, she is 20 years old and its her first time applying for a US visa. We are thinking our angle is that she will be returning to finish her school in Canada .

My Mother In-law is currently(In Canada) visiting with her "parent/grandparent Canadian SuperVisa" She is 56 years old Married and has 9 Children She owns land in Guatemala House and a large farm about 600+ acres that grows papya and also raises beef cows, Of her nine children 2 are Canadians living in Canada, 2 are living in US since 1999 illegally (pay US taxes and have children US citizens) and 4 Guatemalans

She applied for a US visa from inside Guatemala two times in the last year and has been denied. It was a surprise to us The first time we had all her documents and she had 25,000 US in the bank, they denied her quickly, they asked who will be paying for the trip and she said her sister invited her and her sister is paying, since she didn't include her sisters tax returns they denied her, didn't even look at the land documents or her bank account documents The Second we got her sisters tax return and applied again Denied again with no reason.

After she was denied the 2nd time right after he asked if she had any children in the US, and she said No children in the US(because they were illegal) our plan this time is to tell the truth about her 2 daughters living Illegal in USA

What chance do they have?

We think it may be easier to get the visa applying from Canada (Halifax office)

we are planning to get the interview together would it make a difference together or separate

also wondering if I or my wife would be aloud to come into the interview to help translate (Spanish)

also wondering if they do reject the B1 , I would like my mother in law to ask the interviewer for a transit visa, there are very few flights from Canada direct to Guatemala and expensive

She can try but it seems that she has more reasons to stay illegally than return. Every visa applicant is considered to have immigrant intent. Your mom seems to have more reasons to stay in the US than return home.

What will the transit visa do? It's not meant to stop off and visit people. If she's denied a visitor visa and then asks for a transit visa it looks as if she is desperate somehow to enter the US. That would likely make a consular officer think that she will not leave.

All she can do is apply. That is the only way to know 100%.

Given that she has lied to a consular official on her previous application - and they will know about it if she tells them the truth next time - the chances are slim-to-nonexistent for a B-1/2.

What will the transit visa do? It's not meant to stop off and visit people. If she's denied a visitor visa and then asks for a transit visa it looks as if she is desperate somehow to enter the US. That would likely make a consular officer think that she will not leave.

I said If she gets denied the B1 , My plan is for her to ask for a Transit visa, Because she every time she travels from Canada to Guatemala she flying right over USA so the transit visa would make finding a flight from Canada to Guatemala less costly if she can connect in Miami, Its not to stop over and visit, just for transit between Canada and Guatemala

And what do you think about the sister in law, is it possible one gets the visa and other doesnt get it?

Also had other questions If i or my wife can go into the interview. I asked this question to the US embassy in an email but didn't get reply

Woud it be better to have the interview together or not ?

and what about applying in Canada vs Guatemala?

What chance do they have? Extremely low since MIL already had two denied visitor visa applications.

We think it may be easier to get the visa applying from Canada (Halifax office) It will not. Shopping different US consulates for a visitor visa will just show how desperate MIL is to get into the US. The Halifax office will be aware that she had two denied visitor visas in her home country, and is so desperate to get into the US that she is trying again from Canada.

No way they will take the chance that she decides to visit her kids while transiting.

Yes , I appreciate your feedback. I was thinking that since she is traveling back and forth from Canada and her home country a few times this shows that she is respecting the immigration laws in Canada and will be of a chance to respect them in USA?

and what is your opinion on the other applicant , say out of 100 1/100 being the worst chance and 99/100 being almost a sure thing

It would depend upon the strength of ties she could show to her home country. Generally, it's harder for younger, mobile people to be able to do this, particularly from somewhere like Guatemala.

As for the sister i would like to hear more feed back. No ties to Guatemala anymore that other Girls her age that i know of. but she is studying right now in Canada and her reason would be to return to Canada to finish her studies. is that not enoth?

No, and the fact she is studying outside of her native country may count against her, not for her. They may see it as she is already living in one foreign country, so may be inclined to try and live in another.

Again, this is conjecture. It's just that younger people often have a more problematic time demonstrating ties to their home country, and doubly so if they're not actually in their home country. The fact that you have relatives illegally present in the US is also unhelpful.

Unfortunately, transit visas are issued according to the same standards as B1/B2 visas and are not any easier to obtain. Basically, the transit visa is allowing you to leave the secure area of the airport and enter the country (if only for a few minutes to connect to a different flight). Unlike some other countries, the US does not allow airside connections for international flights. And once you have left the secure area, there are no restrictions on your movement. If someone wants to illegally immigrate to the US, they could do so just as easily with a transit visa as a tourist visa. So, as many have discovered before you, although making a flight connection in the US would be so much easier/cheaper, it is often impossible.

For the sister, the fact that she is studying English would also likely count against her. If she were in a PhD program in electrical engineering, or something like that where it is a specialized area of education with a commitment to a long course of study, it would be different. But taking classes in English is something most immigrants do anyway and can be done anywhere, so would probably not be seen as a very strong tie to Canada.

having lied once, why would the next CO believe a word she says the next time? As for the student, well, lots of people try that route...they begin studying in Canada, then 10 minutes later, apply for a US visa...I would not expect her chances to be all that good.

Neither you nor your wife will be able to attend interviews for tourist visas....you cannot 'demand' that visas be issued nor 'guarantee' compliance (as evidenced by the fact that you could not have the two illegal children removed from the US, nor do you seem to even care that those two are in violation of numerous laws....)
