my interview did not go through today , because I filed it under 319(a)-marriage based naturalization , but the interview officer treated me as one under 316(a), because I have already hold the GC for more than 5 years. But the officer did not reject me, and told me I'll receive a letter in 2 weeks for further info. Has anyone seen this or similar happened before? or any comments . This is very frustrated....

Note: I traveled oversea very often in the first two years after I got green card, so I'm not qualified for the 5 years rule ( under INA 316(a)) , but I'm fully qualified for the 3 years rule (under INA 319(a))

If you didn't qualify under the 5 year rule but did under the 3 year rule, you should have insisted on applying under the 3 year rule.

I know that sometimes insisting doesn't work because interviewers do not understand the law. People have disagreed with me for saying this but it's been proven time and time again.

You have every right to choose whether to apply under the 3 year rule or under the 5 year rule, but the interviewer may not have known that.

This is assuming that you did spend so much time outside the country 5 years ago that you may have effectively abandoned your green card; this is the only case in which your interviewer may have a point.

You'll have to wait for your interview result, but if it's a denial you'll have to pay for an appeal or just reapply. You could also try an Infopass in the meantime to insist that your application be treated as a 319a application, but that may not be of much use.

I've heard of many 3 year applications being changed to 5 year applications because a 5 year application is more straightforward. This makes sense, but I've never seen it done for someone who didn't qualify under the five year rule. I hope you pointed this out to your interviewer and he should have gone back to the 3 year application.

My interview is next week, I applied based on the 5 years rule, BUT I entered the country because I married an U.S. Citizen. So, will I need anything (photos, any proof) related to my marriage on the interview? I am still married to the same person, and we have a son together. I am bringing our son's birth certificate, our taxes since 2010, our marriage certificate and my green card. Is this enough or I still need to bring proof of my marriage?

Thanks so much JimmyHou, I appreciate your inputs, which are in line with what I assumed. The officer was obviously trying to go with the 5 years route to save time and energy. In the end, I told him I'm not qualified for the 5 years rule, he's supprised and asked why? I told him I had many oversea travel in the first 2 years after GC, he said "oh....."

But it's too late, the time was running out.... I have to wait for the inquiry by snail mail.

Hello everyone,

I was approved today and my Oath Ceremony will be Feb 19th '16.

My interview was scheduled today at 1:15pm, the entire process took 30 minutes. After going through the airport style security check point, I handed my Interview letter to the lady at the front desk, she stamped a date on it and asked to go in line. I was the second person in line so it took like two minutes for me to be called to the first window, the guy took my letter read it briefly entered something in the computer, handed the letter back to me and instructed me to take a sit and to wait for my name to be called, within two minutes (This was express service!! no complaints) a lady called my name, she greet me at the door, asked how I was doing and walked me to her office. We sat down and she asked if I was still married and if anything has changed since my N-400 was submitted, I said no. She then ask for the letter, GC, Passport and Driver's license. She went ahead and asked me to stand up and sworn me in, then asked me if I had any new supporting documentation from 2016 with both of our names, I say yes, credit card statements, Bill statements, she asked if we have filed tax return yet, I replied not yet, we are still waiting for some others tax forms since it just the begging of the month and I offered her our W2's and some other tax forms we have received so far. She look at everything briefly and gave them back to me, then said ready for you civics and history test? and I said yes:

Name one of the two longest rivers in the United States.

When was the Declaration of Independence adopted?

What do we call the first ten amendments to the Constitution?

Who lived in America before the Europeans arrived?

We elect a President for how many years?

What is the name of the Speaker of the House of Representatives now?

Reading portion:

Who was Abraham Lincoln?

Write portion:

Lincoln was the President during the Civil War

She congratulated me for passing the civics test, and ask me if wanted to change my name I said no. She then sworn me in again (Don't ask me why) and we went over the application. She had me sign the application and handed me the civics test passing sheet, then checked the computer and told there was an Oath ceremony for the 2/19, I said it was ok. She then handed another paper asked me to ensure my information was correct and to sign one sheet and print my name and sign another sheet, she went in the computer to make sure there was still space for her to include me in that Feb 19th oath, scheduled my interview and gave me the letter explaining the process for the letter and the ceremony. We were done, she walked me out and said congratulations.

It was a very nice experience....Kudos to that immigration officer!!

My wife passed her interview yesterday! Woo hoo! Only missed one question. Should have the oath ceremony in about 10 days time.
