I am so confused. You were married to a USC but he died. Then you came to the US on a tourist visa and overstayed. Then you married another USC to whom you are still married but he did not file for you to get your green card. Now you have a new USC boyfriend that you want to marry (after your divorce is final) and have him file for a green card. You are raising all kinds of red flags here.

Not only did she say she was married and her husband passed in a previous post (August) she also stated "because of the love i have for him i have remained single till this date".

So somewhere the truth isn't being told. Either she remained single to this date or her husband passed, she remarried- 2nd husband is in rehab and now she wants to marry this guy even though she is still legally married.

What's the real story, OP?

09/2015- Visited Nigeria again!!!
10/28/2015- NOA2 (237 day wait at TSC)

11/27/2015- Arrived at Embassy
06/2016- Third visit to Nigeria!
06/15/2016- Interview, given option to file I-601 waiver.
08/16/2016- Waiver submitted (no lawyer).
11/21/2016- Waiver approved with expedite.
01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

No my former could not keep to Imigration appointment I got work authorization but could not make AOS

appointment with him. He has been on rehab for drinking and smoking so we decided to end the marriage after withdrawal from immigration.

For me to go on with my life married a new new man this is what happened

Forgive me OP but this post wreaks of greencard hunting

Even with this riddled with scam...

You can't file when you're not free to marry AKA you can't file until the divorce is finalized. You are NOT free to marry while divorce is pending, you are ONLY free to marry once the judge has signed the Divorce Decree/Certificate.

So no, you can not file for your new... husband/boyfriend/whateverheis.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You must finish the divorce proces first, than apllaying for whatever you want, neither k1 visa I 129F or I 134.

It's says that YOU MUST BE LEGALY FREE TO MARRY SOMEONE IN THE ORDER TO APLAY FOR A PETTITION. IN YOUR SITUATION, EVEN IF YOUR DIVORCE MAYBE BE AT THE END, YOU STILL HAVE NOT GOT THE PAPER FROM THE COURT, YOU STILL CONFIGURE MARRIED IN YOUR PAPPERS. YOUR BIRTH CERTIFICATE SHOWS DIVORCE WHEN YOU ARE DIVORCE.

My advise is to wait before filing, don't loose time and money in an application in the situation you are in.
