Hey guys..

it's been about 3 months we got married and I applied for AOS through K1, work permit and travel document. So far only received a letter for biometric/finger prints and that was done 2 months ago. Any idea how long would it take? Also, is their any way I can check the current status of my application? I'm getting sad and restless.. I really wanna visit my family and start working. Sitting home is driving me crazy..

Also, at this point my K1 90 day visa has expired too. Not having any notification from USCIS am I considered to be 'illegal'?

You are fine as of right now. Depending on your case and where you live will decide on wither they will schedule an interview for you or not. They might approve it with no interview, that happened to two of my wife's friends. While my wife had to go to a an interview.

As long as you have the confirmation letter then you are good as of right now.

If you have the NOA hard copies, they will have your receipt numbers, much like you had for the K1 process. You can check the status of those on the USCIS website. You can also create an account on the site, and attach those case numbers to the account, and ask for email updates from the website.

I'd also recommend filling in your timeline further, and checking the AOS forums for people with timelines similar to yours, so you know when to expect updates.

It can currently take over 12 months to receive a Green Card if you are adjusting from a K1, especially if they classify you as an Interview Waiver case (check this thread: http://www.visajourney.com/forums/topic/560617-notice-of-potential-interview-waiver-case-part-iii/ ).

You can check your case status online on the USCIS website with your I-485 NOA receipt.

You are not considered "illegal". With AOS pending, you are in a period of authorized stay. No need to worry.

Your K-1 visa was null and void when you used it to enter the US. Your I-94 expiration date no longer matters because you have filed for AOS, which places you in a new period of authorized stay while your case is being processed.

If you have filed for EAD and AP, it takes 70-90 days, sometimes a bit over 100 days.

With an interview you will receive the GC sooner, with an interview waiver letter it can take a year or more.
