CSPA - eligibility and letter question

9 posts in this topic

Recommended Posts

This question is for my brother in law.

His aunt is a us Citizen and applied for him and his parents in 2003. He's over 21 age now.

Is he eligible for cspa? Also do we need to send in any type of letter to uscis stating that he's still unmarried?

Thanks in advance.

He certainly could be.

The dates you need to know is the original notice date when they sent the petition and the date of approval. You calculate the difference between those dates and subtract that for his real age to get his immigration age. If it is under 21 he can still come with his parent.

This will not be over quickly. You will not enjoy this.

Yes which is also the priority date and you can find it on the i797c notice of action form.

The date of approval is on the i797 notice of action form.

Hi,

Google "CSPA calculator" to see if he qualifies for CSPA protection. You need to have 4 pieces of information; his birthdate, the Priority Date (PD), the I-130 approval date, and when date when PD became current.

A letter is not needed.

I'm not sure about the i-130 but they have an i787

Birthday - Sept 1988

Approval from (i787 or 878): Jan 15 2010 --- is this the approval date we are talking about? Their file hasnt been approved from USCIS yet so the case is still pending but we are expecting their case to open in next 6 months.

Priority Date: October 2003.

Did you Google the CSPA calculator and entered the dates?

Did you Google the CSPA calculator and entered the dates?

Just did. it says he's eligible. but the question is, do i need to let USCIS know that he's not married and qualifies? or do they automatically count him in?
