My wife in Australia has been declined visiting visa 3times in the past due to incorrectly filling out forms and not providing enough evidence of returning back to Australia..is the declination permanently recorded on her passport?? Can she get it removed??

The denials have been recorded. They do not go away. I was denied entry to the U.S. in 2008 and was asked about it in December when crossing back into the U.S on my green card.

It is not on her passport, it is associated with her.

Were the previous occasions with an Indian passport?

Seems like leaving a child behind is pretty good evidence that she intends to return home.

I was told by CBP that a child is indeed NOT a good enough reason as children can be petitioned for, cared for by family members or simply abandoned. Sad but true.

Plenty of evidence on here of people leaving children behind, I was surprised but have seen too many posts where it seemed quite normal.

The denials are on her record, but if her circumstances change (ie she has far stronger ties now), she could try again.

If you are considering a spousal visa now, then do not worry- since the CR-1 is for people to immigrate, the government previously having had suspicion she wants to immigrate has no bearing on approval.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Based on all written here, doubt she'd get the visa. Sort out marital issues via skype or when she gets her immigrant visa.

Also, as someone who traveled at 32 week pregnancy for 19+ hrs with layover (one leg in business) - I wouldn't do it again if someone paid me. So uncomfortable.

And with the understanding she'll have to endure it all again in just a week's time.

Under these circumstances, I wouldn't want to engage in any kind of discourse that wasn't going to end in a definitive 'yes, sweetheart'.

yeah given the new information from the merged thread, she won't get a tourist visa, and in fact her reason for travel could negatively impact her spousal visa.

Dude I a always one to encourage but this one

looks like a tall order here....this is what 28-22 hrs

travel time...depending on where you are, and the

lay-overs? ....would it be Dubai, Singapore or ???

L'd not have my pregnant wife do that trip alone,

swollen feet ,nose, back-ache, lots of bathroom

visits....this would have to be dire emergency. I

don't think the CO will issue a visa to visit even

though she will leave her child home in AU..it

will smack of immigrant intent...the baby will be a

USC even if born in AU.... and if U cant make the trip

Skype is the next best thing, gather the family around

to be part of the convo & mediate ...I don't see her

getting the visa bro...sorry
