I need advice please!

Guys I want go to US embassy in Managua, Nicaragua to try get a tourist visa, but l'm afraid because it could be refused. I have already immigrant visa process with pd DEC 02 2013, but I want go to see my Wife only 1 week. Then come back home to wait complet our process.

What should I do? Sincerenly !!!

USCIS Stage:

Dec 02 2013: Priority Date

Feb 28 2014: NOA 2 Received.

Aug 14 2014 : No Visa available letter

Feb 25 2015: DS 261 Completed

Feb 26 2015: AOS Fee Paid

April 10 2015: IV fee Paid and IV Packet sent

April 11 2015: DS-260 Completed

April 13 2015: Resend I-864 to NVC with Check list and Bar Coded Cover Sheet

April 14 2015: New Scan date Asigned

May 8 2015: E-mail with 2nd Check list, CC but I need new AOS form for interview day, because item missing.

May 14 2015: Case complete by e-mail.

If you don't apply then your chances of not receiving the visa are 100%.

I'd say give it a shot just like HYPNOS said. Make sure you can show evidence you have strong ties to your home country. Good luck with your application.

Yes let try with evidences except no, you have Nothing to loose! Why people with Esta visa like I can travel and not other tourist visa it ll be very unfair!

There is no harm in trying and taking your chances.

But just FYI - I tried the same thing for my spouse in INDIA and it was reject. This is not to discourage you from applying for the tourist VISA.

You never know- you may get it... :) :)

They will know about your wife because you are required to list her on the application form.

They do not have all records on you.

Tell the truth.

Changing your scenario can backfire as the US Embassy is versed in common tricks people use to get visas.

Your chances of getting rejected is almost 99.9%. Since your wife is in USA and you applied for F2A visa, you have lot more reasons to stay in USA than to go back. I tried the same for my wife and got rejected. I even had a California Senator to send a recommendation letter to USA embassy. If you have 150 dollars to waste, give it a try.

If you give it a try, be honest and don´t get it … you don´t lose much (just the $$). But if you submit an application with false info. , like lying about your wife in the USA and they catch you, you will put at great risk your other process for immigrant visa.

Advice = Be honest and tell the truth, don´t risk it!

OK, but I do not going omit nothing, I have other family in California, my wife lives en New York, I not thougth in hide our info from us, when I said "change scenario" to apply to visit them instead of her.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

No offence, but what exactly could that letter have done? How could this senator have guaranteed that your wife would abide by the conditions of a tourist visa?

If anything it could have given the impression that you're trying 'too hard' to get a tourist visa.

To the OP, if you've got the money for the application and can spare the time to go for the interview then you've nothing to lose by applying.

If it gets approved - woohoo, happy days.

If it gets denied - not great but as long as the denial is only because of lack of ties then it will have no effect on your immigration visa.

When I last applied I was 95% certain I would be refused. I was absolutely gutted when I was refused but for the sake of that 5% chance of approval it was worth trying for.

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

No offence taken. Every USA embassy in the world has a representative for the senate/congress to whom the senators/congressmen can correspond with regarding consular matters. I know there were tourist visas approved because of recommendation letter from senators/congressmen, but those petitioners didnt have a F2a like visa pending. Senators/Congressmen can vouch for the veracity of the petitioners. There is nothing like "trying too hard". Please do your research before you comment.
