Mayfield - I am still waiting here for biometrics . My husband doesn't agree on calling Uscis since our attorney gave us timeline for biometric as 1-2 months from filing .

As usual , I don't agree with him ? but decided to wait

As of January 13, 2015, we are ready to schedule your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSCxxx, for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

It doesn't say though when we can expect the interview notice. Has anyone else's changed too?

I have the same change of status. It changed to this one week after I completed biometrics. Status of my 765 & 131 are as before though - "Case was received".

Did biometric walkin today. The man at the entrance asked why we wanted to do a walk in a week early. We told them we are traveling to California next week . Then was asked proof of travel n we said we are traveling by road so there is no proof. Then was asked duration of visit which we mentioned as 4 days . He then called someone I phone and we were allowed in.
Our scheduled appt is on 02/03

Thanks everyone for the answers on my RFE! I hope your biometrics' appointments come soon enough if you haven't done it yet!

Just an update on my case, the RFE letter gave me 2 options: get a joint sponsor or show some assets to complement my husband's income.

We are then showing my assets - cash in my bank account from the sale of a condo. The sale is just about final, real estate agent is keeping me posted.

I also need to translate the last 12 months of bank statements from my bank account, working on that. I'll make sure to attach the buyer-seller contract and a translation, to prove where the money came from.

Just curious . . . did you not already know when you filed that the income shown on the I-864 was not enough . . . or was there some reason they did not count some income you filed . . . or what?

I have Form I-864 dated 3/22/2013 and Instructions dated 3/22/2013.

Instructions say:

Part 6. Annual Household Income

This section is used to determine the sponsor's household income. Take your annual individual income from Item Number 5 and enter it on Item Number 6.c. If this amount is greater than 125 percent (or 100 percent if you are on active duty in the U.S. military and sponsoring your spouse or child) of the Federal Poverty Guidelines for your household size from Part 5., Item Number

8. , you do not need to include any household member's income.

This seems to be misworded. Item Number 6.c is the current income for Person 1, if income from a Person 1 who is a member of household is being counted.

It seems the Instructions should say: Take your annual individual income from Item Number 5 and add to it any numbers listed in 6.c, 7.c, 8.c. and 9.c. and enter it on Item Number 10.

Did Biometrics yesterday and a few hours after I got home I got a text "Request for Evidence". I want to believe that it as to do with the tax return what my husband printed from the IRS website. My question is for you guys who didn't get a RFE what tax return did you sent in with your package? Still waiting for the mail will update soon.

I'm sorry! I know the feeling when I received my letter for RFE in the beginning of the month. You should receive it in 5-6 days. Hopefully it's something easy! Good luck.

I also printed from the IRS website but I think that it is not what they want. They want the complete tax return submitted to the IRS, meaning whatever his/her accountant sent to the IRS.

Hi Leo,

I already knew my husband's income tax was not enough. I put my car as an asset to complement the income. But, that was wrong, I later read I-864. You can not use a vehicle as an imediate asset if this is your only vehicle. You can use the vehicle if you have another one that you can use to drive. And I am assuming both need to be paid off. So now I sent them my account balance with U$88,000.00 dollars... I think cash should be good enough to cover whatever my hubby didn't have. Cash came from a condo sale and I put proof of that so they don't think that I just randomly got some money in my account to show them, it's important to do that.
