November 2014 Filers (I-130 Petition) IR1 / CR1 Spouse Visa Process

It is very confusing. I had to do a LOT of research to understand the whole process. The first email you received, NOA1, just informs you that the Chicago Lockbox received it and where they are forwarding it. It also gives you the case number so you can track with the USCIS website. The Texas service center with USCIS will approve it which can take months. Use the tracking tools to get a better idea. http://www.visajourney.com/timeline/

Also check out : http://www.visajourney.com/content/i130guide1

And what happens after the NOA2 when it is routed to NVC if you want to prepare ahead : http://www.visajourney.com/wiki/index.php/NVC_Process

Hope this will provide you with some clarity.

I cheked out wht happens after the NOA2 when it's routed to the NVC but it states not to you it on the website

"Do not use this tool if the approved petition is in one of these categories:

Approved petitions in the categores below are not subject to annual limits.

  • IR-1: The spouse of a U.S. Citizen
  • IR-2: An unmarried child (under 21 years of age) of a U.S. Citizen
  • IR-3/H-3: An orphan adopted abroad by a U.S. Citizen
  • IR-4/H-4: An orphan to be adopted in the U.S. by a U.S. Citizen
  • IR-5: Parent of a U.S. Citizen who is at least 21 years old"

Im living in the US but my husband is Canadian and works and lives in Canada. i guess we face longer time to process or approve since im not abroad. not sure why that makes a difference except that maybe they think you should get preference to come home to pay taxes sooner?...lol. i need him here as much as anyone wants their spouse in the US living under one roof as a family. But i feel for those who only rarely get to see their spouse...i wish everyone the best. :)

Yes I am not sure of the logic behind it either. If I were a permanent resident of South Africa we could file via the consulate here and it expedites it incredibly fast. So maybe it has to do with the DCF (Direct Consular Filing). Not too sure thats a wild guess.

Anyways wish you all the speediest of processes!! I agree that it is very difficult for those who aren't able to see one another often. I move home (US) in a few weeks and just pray the time will pass quickly. Separation from your spouse is just torture.

If you filter by Texas service center that will give you an idea of where they are at in the processing of Cr-1 and IR-1 visas.

Stupid question if my I-130 was sent to the Texas Service Center does that mean USCIS approved my I-130? This is the email that I received:

"Your case has been accepted and routed to the USCIS Texas Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number SRC1590054895. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status."

How long did it take for you guys to get your NOA1? My mom sent my forms for me Monday...(of course there was Veterans Day to take into consideration)...she never asked for a tracking number so I'm not sure where it is. I hate waiting and not having any sort of tracking!

Is it worth filing the I-129F for the K3 and K4 Visa or just wait out the whole I-130 process

I am not sure about the I-129F.... is this for the kids? Not too familiar with that process, hope someone else can help you out!
