Travelling outside for Honeymoon before Adjustment of Status!

Hey guys,

I know I won't be able to leave the States before getting all the proper documents (I will apply for the AP for traveling), however I was just wondering if right after the wedding we could travel to Puerto Rico since it's US Territory. Can it be a problem to me since they can consider I am resigning my 129F Petition?

I guess a cruise to the Bahamas would actually be more complicated even though I have no idea how's the passport control at the Port (We would leave from Miami Port).

So long as you fly nonstop from the mainland to PR you will be ok. Have your passport handy for it is common for ICE to be present at the gates in PR for flights bound to the mainland. Until you have your AP on hand you shouldn't leave the US otherwise you won't be able to return.

A cruise is problematic. Going to the Bahamas is leaving the US so it would be a bad idea if you plan to return to the US. Even if you choose a cruise where the ship may not plan on entering foreign territory or docking outside of the US, 'stuff' happens and the ship may end up having to dock outside of US territory for repairs or bad weather or other unexpected situations - which means that you would have left the US and will not be allowed to re-enter. As John R. mentioned, flying to Puerto Rico on a non-stop flight would mean you haven't left the US (it would be the same thing as flying to Hawaii), and you would be able to return to the continental US without a problem as long as you have proof of your valid I-129f status in your passport to show that you are not a foreign national trying to enter mainland US via this route.

Have with you a copy of your I-94 since K-1 visa on your passport is expired when you enter the US. Keep in mind that, although most people have returned succesfully, AP is supposed to be used in case of needing to travel on an emergency, there have been some that were given a hard time when returning using AP

Puerto Rico is the U.S. and non-stop flights from and to the mainland U.S. are just like any other domestic flights. Like others have said, travel with your passport and I-94 wherever you go.

once you have you`re EAD/AP combo card, you can travel to any country that allows you entry with you`re Brazilian passport and then you re-enter U.S. using the U.S. issued combo card. AP while adjusting status (AOS) from K-1 visa is NOT only for emergency use, vacation travel is fine.

This is by far the safest plan.

Until you have your green card, keep a copy of your marriage certificate with you at all times. We found that this was crucial when the wife traveled on AP, and when we encountered inland CBP checkpoints.
