Also, keep in mind that even if you are lucky enough to get the tourist visa, the immigration officer can still deny you entry for any reason. Including you being in processing for a k-1.

To skip the whole process. It happens. People in this thread have even considered this very idea.

When my fiance applied for a tourist visa they flat out denied her because of it. My congressman's office also said it's not worth even trying since it's almost always a denial when you are processing.

What would happen with those people that decided to skip the process and just stay? Like how would they be able to work or get healthcare, basically just hide out for the rest of their lives?

ive heard stories of some people that have been in the country illegally for years and are given residency if they go through some process, is this true?

My friends brother apparently just came to the US and got married without any visa and now they have given him documents overtime, this whole thing is confusing me because i thought k-1 is the only way to do it? why do those people get it easy?

You can get married in the US and file that way. Being in the country technically "illegally" is forgiven once you apply for the spouse visa. The whole tourist visa process is to make sure you will leave the usa. If you are engaged to someone in the usa, your chances of leaving go down pretty significantly.

The benefit there, is that you live in the usa during the process.

They don't want you to do that because you are going around the process. Not to mention, possibly committing fraud by lying about the reason you are visiting.

I'm kind of surprised anyone would bring up the fact they are currently in the application phase of a k-1 visa. It's almost a guaranteed denial for a tourist visa.

Sweden uses the VWP so it shouldn't be a problem, as long as you have proof of going back home.

Yeah, that's true. If the benefactor's country has a visa reciprocity agreement, coming to the USA is *much* easier. If they don't, then you have to go through the tourist visa interview process.

heres something interesting, i recently checked my i-94 travel information on the CBP website and it showed that my previous visit was non existent, but my older ones still show and it clearly states this is the database that the officer uses. I remember he just looked and my passport and just said "thank you, next".

my question is do they not record visits sometimes? im assuming this is a canada-US thing only.

well my fiance is from the US and they have erased all her records, and some of mine are missing and in a messed up order, showing that I arrived multiple times but never departed etc

Well Sweden is part of the ESTA group and so I don't have any issues coming through. The officer asked me what the purpose of my visit was and I said "visiting my fiancé for three weeks". He then asked if we were in the process of applying for the fiancée visa and I said yes, which lead us to talk about it.

Now that *is* actually interesting. I was under the impression that perhaps the IO's had no idea what applications might be pending for you.. but if he asked such a question.. perhaps they do. Curious!
