My fiancé came here in April using a k1 visa . We got married, he received his work permit but the green card is in process. We didn't go to an interview yet. I want to divorce him and make sure he goes back to his native country. How can I do that? Any advice? I was thinking abt calling immigration to come get him, but he is not illegal

Why struggle to live with someone who clearly does want to be with you? It's better to react early than to suffer all your life. Marriage is supposed to be happiness not pain.

If he gets deported how will I obtain a divorce from him?

My comments had nothing to do with your reasoning, I take no opinion in them because they are true to you.

My comments were with your choice for words to do with deportation.

You should divorce him before deportation.

Does he know you want a divorce so soon?

Some people come here and are abused, other arrive and start abusing. Lucky for most of us we are not at these extremes. If the OP wants a divorce and NOT to be on the hook for this man for life possibly she can terminate the I864 and the AOS petition will be impossible. She should also be careful that he doesn't stage a fake VAWA claim as it ruins lives. Many people jump into things they aren't ready for. Neither the US person nor the foreigner should move based on a relationship they are not 100% certain of and they shouldn't go into this without extensive face to face time ( monitor to monitor is a poor imitation )

This will not be over quickly. You will not enjoy this.

You need to get in touch with USCIS asap and withdraw the I-864 to kill the petition.

You can't withdraw the I-864 once he has adjusted status - that's a bit ambiguous with your original post when you write his green card "is in process". If he hasn't adjusted status, then you can.
