And thanks for the supportive words. That's what I am working on right now. to get a permission from my boss to either work from home or give me a big unpaid vacation. I know this is not realted, but does anybody know, if let's say I moved to Azerbaijan and worked from there and lived there for 6-12 month. would that affect spouse visa process?

If things are still going the same way they are now you *might* get auto-expedited since you are a USC living abroad. You'll have to provide more evidence of domicile and your intent to return to the states.

I'd agree with others that the most likely cause is the family ties that you've had for most of your life. They think that you've been friends with this person and her family for most of your life and that as a friend you are trying to help her immigrate. From the sounds of it that is the most likely cause of the denial with the information that you've given.

Marriage is the first option to show that you have every intent of marrying and building a life together. Of course, if there are other reasons for the denial then they could come up again.

If you decide to get married and apply for the spousal visa, you should emotionally prepare yourselves for a long, difficult process. Hopefully the wait times will be better for you than they are now. Living with her abroad would be the best way to save yourselves a long, hard time apart.

When you get to the AoS stage you have to prove your current income. I have no idea how you do that if you are working a job abroad that is ending.

Get a contract for when you return to the states??

Someone else will chime in on that issue I'm sure.

Of course you can always ask for a joint sponsor.

I am just going to throw in my 2 cents since my fiance was denied without reason almost a year ago. I think that unless the CO is 99% sure that your relationship is real they do not approve. My fiance and I have been together since 2010, we filed for K-1 after two years and met all the requirements. After the long wait, he showed up at the interview, was asked a few questions, and then handed a white piece of paper saying we are sending your case back to USCIS without reason.

It was awful and heartbreaking for both of us, so I feel your pain. I am truly sorry.

There was no real reason to deny our petition at this stage other than they just didn't believe. The CO did ask why we didn't marry in India, implying that maybe our families didn't approve of our relationship and that we were just doing a K-1 to avoid family issues. The CO's know full well the cultures of their respective countries.

We decided, and after speaking to an immigration attorney that the best option for us was to marry in India and file for an I-130. That's what we did.

After marrying on Christmas in 2013, full blown Manipuri wedding with over 500 people in attendance, we started our I-130 petition. Also, within my cover letter to USCIS for the I-130, we withdrew our k-1 petition. A week later we got a letter in the mail stating that our K-1 has expired and feel free to reapply.

I know it's hard now, but you do have options, and it will all work out.

I am also wondering how your petition was approved so quickly. I hear others on here complaining about how long their k-1 is taking, you were approved in only 30 days. Maybe something on the part of USCIS was not completed before it being approved and sent off in error to NVC and then the embassy. Just a thought.

Nah, for a while I-129Fs for K-1 visas were being approved lightning fast! It would seem that it isn't the case any longer.

If I was you, I would e-mail directly to the field office dirrector at the embassy she interviewed and request an explanation and review of the case. They have the responsibility to let you know the reasons for the denial. Also, was she offered to apply for a waiver?. Just in the case she has any issues, but for that they have to give her a letter, right on the spot. I contacted the field director of my consulate with a request and she gladly accepted. It´s worth to try. Good luck.

They definitely will let you know if you have a ban and can or can not apply for a waiver.....

So its apparently NOT a waiver issue or an inadmissibility issue...if it was why would the officer not tell her?

OP, no offense intended at all just thinking, is there ANY chance at all that your fiancee is holding some info back from you, perhaps she is worried or embarrassed about something in her past she is uncomfortable to share and therefore did not share the denial reason with you or some part of the interview with you?

In that case the embassy should tell you if you contact them.

IllianaB are you sure that they MUST tell you the reasons for the denial? If that was the case, then they would have done that since they tend to work "by the book."

If they suspect fraud are they required at the interview to state that to the applicant? I really dont know, Im just asking.
