No Reason Denial. URGENT HELP.

Good morning guys. Just had interview... Denied... Was told docs are getting sent back to USCIS and if we have questions contact them. no explanation what so ever.

My fiancee had to go travel to a different country for the interview. Is there anything she can do there now? or she can leave the country and go back home?

The only POSSIBLE reason I can think of they could deny her is that she studied in Russia for the last 6 years. and just graduated. so she had no job, no commitments back in Azerbaijan:( COuld that really be a reason?

Other reasons such as proof of relationship, meeting in person, financial support etc is out of questions. we never even got an RFE in the original petition:(

This entire process was going too perfect:( I knew this was too good to be true to be with the love of my life in less than a month:(......

My life is crushed right now...

I can not believe this happened. I want to wake up:( all efforts, all plans, money, everything is WASTED:(

If I recall reading this forum correctly, if petittion goes back to USCIS that's pretty much a no no and it makes sense to get married and apply from scratch. Is it even worth calling USCIS like we were advised after the interview?

Unless the consulate had substantial evidence to doubt your relationship, USCIS will review your case file and hopefully re-affirm your petition then send it back to her consulate for final processing! keep us posted with any updates. All the best of luck to you both :)

Contact USCIS so you know specifically what the issue was.. I hope it is simple and straight forward... best wishes.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number
Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

What does it mean? They gonna request another interview if/when they re-affirm? or?

I read on this forum that it stucks in USCIS once it gets sent back there and they let it expire so it doesn't look as actual denial, cuz denial looks terrible and considered fraud and up to a crime in some countries.

Is this not true?

If Yes, I would get married and apply for spouse visa.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Prediction 04/08/2015

For a fiancé petition it will not be reviewed and reaffirmed, it will be allowed to expire.

I suggest you go spend some time with her and get married. Of course document the visit and the wedding well so you have lots of evidence to send with the spouse petition.

Your fiancee is not the one that needs the commitments to her home country, income etc. That is your burden to prove.. that you can support her etc. I am not sure who you should speak to specifically but are either of you able to call the interviewing office and ask them.. I hope someone with local knowledge can assist you with this..

Yeah, I provided everything they asked/required and even more to prove that i can financially support her:(

and from what I read on this forum, it is pointless to call Embasse. they will not give oyu any information. and in USCIS there are dummies that don't know what they are talking about.

i just can't believe that this is it. Have to start from scratch and not gurantee that they won't deny our spouse visa for the same reason(Which I DON't KNOW what it is) This sounds so not fair because there is no specific reason or if there is a reason that they can't tell me:( don't we have a right to know a reason?:(

Hey, I know.. it is devastating. You need to get some response from someone more familiar with that territory.. try looking on the relevant forum - http://www.visajourney.com/forums/forum/100-regional-discussion/

Otherwise you could start your own thread. Its a starting point to find a process to follow. There will be a way so just hang in there.

So devastating! I think its so wrong to let people spend all this money, go through this lengthy, stressful process, and then deny them without any information or reason. I love how US citizens try to do things the legal and right way and get treated like dirt. How do you know what to fix and better prepare for the next time if you don't even know the reason you were denied?! I'm so sorry this happened to you. I hope you can find some answers and find a way to be together!
