Is "co-mingling" evidence required for the AOS?

Hi everyone.

We are sending off our AOS package today and wanted to know if we need to send evidence of us living together? I have our apartment lease but that's about it and a few pictures at the government center that we got married at but none in the court room because no cameras were allowed in there.

You do not need to include any evidence of a bona fide marriage with your packet. Please read the I-485 instructions.

Think logically about this, how much evidence do you think most people would acquire in such a short time period? Little to none. Why then do you think you'd be a special case that required something that was not asked for or pragmatically available to most couples?

None for the AOS package. But I highly recommend you start gathering your documents that show proof of "co-mingling" should you have an interview, like adding spouse to bank accounts, auto/health/life insurance, adding each other as beneficiary, and etc. (basically what normal couple do after they get married). It also makes it easier when you get to the ROC stage of the process.

No documentation of marriage with the application but the marriage license.

And the vote is now 4 - 1 in favor of no additional evidence.

I certainly didn't add anything but what was asked for in the instructions. You may be required to furnish some co-mingling evidence if you have an interview. (Ours was waived)

and another, you're not expected to have anything when you file, just start saving it for later, interview or ROC in a couple of years. Do it soon so when you file for ROC you have stuff 2 years old and newer.

It's not required to send anything in. However if you have an interview, my IO asked me for pictures and anything that had both of our names on it. AGAIN its not a requirement, but if you can start collecting now, you might as well in case you end up having an interview and an IO that coudl possibly be having a bad day. Just my .02

Just an FYI. We filed an I-485 AOS from a K1 and received a Notice of Intent to Deny that, among other things, requested evidence of a "shared life". I'm going to start with bank accounts and medical insurance that shows her as a beneficiary and see if that works.

For what it's worth.

But, people here are right...it's not requested or required in the initial filing.

Oops, I DID send a lot of bona fide... No photographs though but some paperwork showing we live together and have same bank account and...a child... I hope it was all good...

I just thought that it would be better to file it, instead of receiving RFE later on..

Is there any harm in sending pictures and evidence of "shared life" with your AOS just to eliminate any potential confusion? I'm reading posts where people are saying the local USCIS office isn't familiar with the rules for K-1 and giving petitioners NOID's. My lease is up in December and I'll be moving during the process and would like to avoid the possibility of getting a NOID/RFE.
