I haven't gotten my noa2 as of yet but, i have been reading over some of the things that are required on I-134.... if i make a lot more than the 125% do i still need to get my statements from the bank?

No. You only provided I-134 form (signed and dated by petitioner), W-2, and the most recent tax return. My husband also provided me his bank statements, stock and bonds, life insurance policy but they never asked these before my interview.

mainly for the interview preparation, but also partially because we wanted to be completely transparent with our fiances.

The I-134 instructions don't mention anything about certain other assets that could represent a substantial portion of one's net worth. I'm assuming that it's because they are less liquid and couldn't really be readily used to "support" the fiance.

The kinds of assets that I'm thinking of are: 401k, IRA, ETFs, mutual funds, Health Savings Accounts, cash balances in a brokerage account, etc.

What do you all think of these three ideas?:

1) My plan is to take a literal reading of the meaning of amounts "on deposit in savings banks in the United States" as balances in savings/checking accounts only.

2) Also, I planned to interpret "other personal property" as tangible property such as the trade-in value of a car.

3) Finally, I plan to take a literal reading of "stocks and bonds" as exactly that, and not include the other financial instruments that I mentioned above.

For context, income is not an issue (> 125% FPL).

Though it seems like the different consulates evaluate petitioners in different ways (ours is Rio de Janeiro, for what it's worth), any insight/experience would be greatly appreciated.

USEM only asks for the most recent tax return and W2. If your tax return shows you make over the 125% then you are fine...you don't need anything else. They will not ask for it.

If you meet the requirement through income alone, then no assets need to be listed. You can leave the whole section about assets blank. No bank statements needed. Assets are optional, not required.

I can't remember where, but I would've sworn I remembered reading somewhere that only vehicles after your first one could be counted as assets. In other words, if you just have one car, you can't count that as an asset.

Does this ring a bell with anybody else, or am I just going crazy?

USEM only asks for the most recent tax return and W2. If your tax return shows you make over the 125% then you are fine...you don't need anything else. They will not ask for it.

This is great news. My tax return from 2013 does not have above 125%, but I have a letter from supervisor with letterhead saying i make this amount current income which is above 125%

will that be good?

You are about $400 short, so do you have about $2k in assets? If so, list them on the affidavit and provide banks statements to prove it. Go back at least 6 months, if not 12.

Yes, it is a true. If you only own one car, then it cannot be used as an asset.

If your tax return shows under 125% but you have current income evidence of over 125% such as pay stubs and an employer letter stating your salary, then you don't need to worry about the tax return.

What you need is your most recent tax transcript or 1040 + w2, and recent pay stubs/letter from employer. That's it.

Is your current income above 125% of the poverty guidline for your household size? If so, you'll be fine. You need your most recent tax transcript and recent paystubs.

Yes, it is a true. If you only own one car, then it cannot be used as an asset.

MY total income 2012 is $33000 with stock dividend.

2013 is only $15200 with stock lost

my annual income is $16800 (from 2009-present)

deposit in saving bank $5000

stock and bonds $49336

Do you think i need a co-sponsor? If i do, I need to prepare i864? Thx
