US Citizen son under 18 LPR

Hello all and happy 4th ,

I am a naturalized US Citizen . My son 17 (October 1996) came to US last year and is a LPR.

Can i apply for a US Passport since he is considered a minor still ?

Hi,

If your son meets the 4 requirements of the Child Citizenship Act, then he is a USC and you can apply for a US passport for him.

CCA

1. Have a USC parent, and

2. Live with the USC parent, and

3. Is under age 18, and

3. Is an LPR.

You can apply for a passport for him if he was living with you AND a legal permanent resident on the day that you became a US citizen. If he became an LPR after you became a USC, then he is not a USC and he can apply for naturalization through the N400 process after he's been an LPR for 5 years.

This is wrong.

No where does it say that his son has to be an LPR on the day he became a USC to automatically gain US citizenahip under the CCA. That language is simply not there.

ANYTIME a child is an LPR under age 18, is unmarried, has a green card, ad lives with a USC parent, then that person is an USC.

So, just so I understand this, if I get US citizenship tomorrow, and then apply for a green card for my hypothetical 12 year old daughter and she gets her green card and moves to the US when she's 13, then the day she gets her green card and moves here, she becomes a US citizen? I must be missing something.

I also thought that my son had to be LPR before my Naturalization. I looked at USCIS for naturalization and he can apply . But he will have to be done with the whole process before October 8th ( if i read it right at USCIS ) which i doubt he will be done with before October.

I am going for his Passport and later for the certificate . It can be done like that right ?

As to the certificate , i guess you are right. I don't see why he would need it in the future when he would have a Passport.

I am just so busy with work and looking upon the case's of daughters and wife's at NVC that i dont have time to research for his certificate IF it will be needed at some point.

Once someone holds a U.S. passport, there is absolutely zero need to ever have the certificate....

Yes, but some people want to have a secondary proof of citizenship in case something happened to their passport. Others get a passport card as secondary proof.

Yes, that's a good idea. My wife got a passport card in addition to the passport, even though she has the naturalization certificate. We also got one for my son on top of the passport, even though he already has a CRBA.
