Thanks! My daughter and I both had our oath ceremony on Friday. She did a name change (changed from my maiden name to my married name), so our ceremony was at the courthouse. Phoenix court house is HUGE!!! 71 people from 41 countries (something like that). It was so much fun getting to down town Phoenix for 8am 2 days before the SuperBowl! LOL Lots of people and activities going on here made for lots of traffic :)

So glad my journey is done! Good luck to everyone who is still waiting. :)

The Journey is almost completed. Passed the naturalization interview. ^_^

I arrived 1 hour and 30 minutes early for my interview. I walked to the Naturalization waiting area glass window and dropped off my Appointment Notice in the wooden tray. Then someone on the other side of the glass window collected the letter.

30 minutes prior to my scheduled interview time, 10 other people and myself were rounded up and followed the USCIS representative. I was interviewed as scheduled (15 minutes time), and was asked to write "Columbus Day is on October 12th" and asked to read aloud "Abraham Lincoln was born in February".

The 6 questions:

1. What is an amendment

2. What does the constitution do

3. What did the Declaration of Independence do

4. What is supreme law of the land

5. What are two rights in the Declaration of Independence

6. What does the President's cabinet do

After the good news, I walked back to the Naturalization waiting area for my Oath Ceremony Letter. About an hour passed and I received the Oath Ceremony Letter and was on my way home!

So I have good news and bad news. When I filed for the citizenship I filled with my parents at the same time. We had finger prints at the same time and also the interview date was the same day.

I passed! Yay and my oath is scheduled for Feb 25

My Mom they need some evidence for her absence. She got sick when she was away and they just need a letter for proof.

My Dad however he had made 2 initial trips when he first moved here and each trip did not last over six months. He came back stayed 15 days and did another trip for less then 6 months and came back. The CO grilled him on this did not even get to the naturalization questions and told him he does not qualify and made him sign a withdraw of application letter and said he can apply again in June. My question to you guys is can the CO do that? He did not break any rules so why does he have to wait?

I don't know the circumstances but going by what you've said.

Did you apply 90 days before your dad's 5 year anniversary ? and at that point, did he meet the Physical requirement(30 months stay) and Continuous requirement(5 year stay with no major breaks)

How many days in the last 5 years was he out of the country(need accurate count)?

Give us these details and someone will try to help.

I don't know if the Immigration officer could have forced someone to sign a withdraw of application - that seems odd.

The interviewer cannot make your dad withdraw the application; that was your dad's choice. However, it was clear that the interviewer was going to deny the application, and he was giving your dad the opportunity to avoid having a denial on his record.

The reason for this was probably because the interviewer decided that your dad's continuous residence did not start when he got his green card. He was effectively living out of the country for most of that first year.

I assume your dad applied based on 5 years of residency... in that case, it's probably safest to wait until it's been 5 years from when he finally came to the US to stay here (in other words, 5 years from when he returned from that second trip). You say that he took those trips when he first moved here, so I assume that was 5 years ago, so he should be safe to reapply in a little under a year from now.

Technically, he could have chosen not to withdraw the application and then appealed the denial. Because the trips were under 6 months, he didn't automatically break his continuous residence, but it is within USCIS policy to sometimes decide that these short trips do in fact break continuous residence. If he's in no rush to naturalize, I think the best thing to do would be to apply again when those trips fall outside of the 5 year period.

Basically, what the interviewer decided was that your father just came to the US that first year to start the clock towards his citizenship, but wasn't really ready to move here permanently. Many people do this; they land in the US, then they leave to take care of things at home... in some cases, USCIS lets it slide, but in this case they didn't. They will start the clock from when your dad moved here for good.

C. Breaks in Continuous Residence​

​

An applicant for naturalization has the burden of establishing that he or she has complied with the continuous residence requirement, if applicable. There are two types of absences from the United States that are automatically presumed to break the continuity of residence for purposes of naturalization.​ [9]

​

•Absences of more than 6 months but less than one year; and​

​

•Absences of one year or more. ​

​

In addition, absences of less than 6 months may also break the continuity of residence depending on the facts surrounding the absence.​

Hi ALL, I just had my N-400 interview test for Naturalization today and on the N-652 the officer checked that i passed the tests of english and another check on Congratulations! Your application has been recommended for approval.... He said i should receive a letter in the mail in 3 weeks. My Question is, Does this mean i passed and just waiting for the oath letter? Interview was in Holtsville NY.

I would appreciate any of you who passed to let me know what they received after.

You passed. A supervisor has to sign off on your application and then you'll be placed in an oath-scheduling line, then you'll they'll actually schedule your oath ceremony and send you an invitation letter with a questionnaire to fill out.
