Hello

Has a primary caregiver, can a childs serious medical condition be classed as an hardship?

As hardship of what, not meeting? For a waiver to overcome a current bar that makes the foreign fiance(e)/spouse inadmissible? Need more info.

An hardship of not meeting. No current bar.

No. hardship. You can travel to meet her. She can obtain 24 hour temporary care while she travels to see you.

You both don't need to meet in each other's country, can be another location. You meeting length only needs to be 5 seconds long, there is no time requirement for the length of the meeting.

Has the non USC already been denied several visitors visas You can't really file if that hasn't been done unless there is a cultural thing against your meeting at all before marriage. Unless you can prove that you can't leave the child with a nurse or other familiy member than no you probably aren't going to have luck. It is very hard to waive meeting before getting a visa.

This will not be over quickly. You will not enjoy this.

So, if the parent cannot find anyone to care for the child and travel, then what about the other fiance(e)? Why can they not travel to the parent to meet in person?

Whose child are you referring to? The US citizen's? or the beneficiary's (the one being petitioned for)??

Ok... so let me see if i can translate vague....

so correct me if i am wrong... the non USA citizen adult (father) is the one you are seeking to bring to the USA? And you are saying you cannot travel to meet him so you want a waiver of meeting face to face because you have a child with a medical issue that you cannot leave. And he cannot come here because of a mental,health issue?

No if any of this is wrong, please correct me. If not. Then no, a waiver would not be an avenue I would say is available to you because by saying he cannot travel for a visit because of mental,health issues, this would also possibly make him intelligible for a visa to immigrate, which would make the whole waiver issue moot.

Plus on a personal,note, do you really want to bring over a man you have never met who has mental health issues that he cannot travel to the USA to live with you and your child who has serious medical,issues?
