Hello again

As beneficiary my sponsor would be filing for myself and my 2 unmarried, under 21 children, representing total household size of 4, income requirement of 29,812.

Sponsor makes 19,500 and we can get a co-sponsor who makes about the same.

My question is what would be the suggested way in applying

Am thinking that my sponsor could file for household size of 3 re the I-134, then prove assets for the diff of 5,237.50 X 3 = 15,712.50 and have co-sponsor file for household size of 2, meaning one of the children as the income required would be 19,662.50. Then co-sponsor could prove assets for the diff 162.5 X 5 = 812.50

Can this be done?

Or does my sponsor have to file for household size of 4, prove assets for (29,812 - 19500) = 10,312.5 X 3 = 30,937.50.

and my co-sponsor also file for 4 but prove assets of 10,312.5 X 5 = 51,562.5.

Please help!

If they are self-employed, they go by Adjusted Gross Income from last year's taxes (unless the consulate has their own special rules). Often self-employed people report lower income and write off their expenses to reduce tax. What is their AGI?

I'm not that familiar with splitting sponsors for large families, but this is barely squeaking by and could be denied, even if it technically passes.

Line 22 of the 1040 is Total Income and that is what is used for self-employed. Line 37 of the 1040 is AGI. They are not one in the same, and are not necessarily the same amount.

One sponsor must meet the total income requirement, you can't split it up between more than one.

Unfortunately, it doesn't work that way. The co-sponsor must meet the threshold for all of your household, so you and your dependents. You cannot "split it in two".

So that would make it a household of The Co-sponsor, Petitioner, Beneficiary, and children.

Dang...Was happy after reading Pinkrlion post, then concerned after Timsah....

Then seeing that our NOA2 was approved I was happy last night.

Now I look on here this morning and am worried.

Cause co-sponsor doesnt meet the income threshold an Sweetwinks is now saying its household size of 5, not four...

Dang ..now i feel even less convinced with the lawyers as we pointed out all this to them before and they said we should be ok..cause we would be able to prove that me and the kids wouldn't become a public charge...They even said My assets could be factored in...

While I know we will be ok financially, we are definitely NOT looking good on paper right about now..

A co-sponsor for the K-1 visa usually needs to be one person with enough income for their own household size plus the intending immigrants. I have not heard of using multiple co-sponsors to split up the sponsorship. With an I-864, you can use up to 2 joint sponsors if there is more than one intending immigrant. I have just not heard of this being done with an I-134. Why not just email your consulate and ask them directly if they would accept multiple co-sponsors, one for each intending immigrant, or your I-134 for your fiance(e) and one K-2 and a co-sponsor just for the other K-2? The consulate would be able to let you know what they are or are not willing to accept.

Ok while I await guidance from the team...

I still havent gotten confirmation on the AGI but will have it later this evening....

1. SO my fiancee needs to prove 100% of the poverty level on the I-134 which is the next step to qualify, and this comes to 23,850 for all 4 of us to include myself and 2 children?

2. Fiancee last tax returns showed 19,500 which has a deficit of $4,350...From what I have been told this can be proven with assets of three times amounting to $13,050...Which we can prove with cash alone plus property if needs be.

3. For AOS the I-864 requirement for family of 4 would apply $29,812...our deficit here would be $10,312..(29,812- 19500)..So total asset to prove this would need to be $30,936.....here again we could prove this with cash alone plus property as I would be in the US by then and can use my savings meaning add to my fiancee joint account...

4. Also my fiancee has accepted part time continuous part-time employment, which should be able to add more to our cause by Oct which is about when we would be looking to file for AOS.

In light of the above, are we still required or encouraged to use a co-sponsor?

If you have enough assets, then try it without a co-sponsor. The more assets you can show, the better. You need to show proof of ownership and value of the assets. If you list property, you need to provide an appraisal of the value plus documents of any liens against it to get its net value. Be aware that some consulates still want to see 125% even when using the I-134.
