Hi my name is Suzy Iam a US Citizen and I was trying to get some help on filing a fiancé visa for my fiancé. I have asked so many lawyers (maybe 5 or 6) and got different opinions (file/don't file/vs get married and due spouse visa) and none seem to know for sure. He is originally from Egypt and fled to France due to religious persecution towards Christians in Egypt. By the grace of God he got the asylum refugee papers approved a few days ago and now we wanted to start filing the fiancé visa so that he can come here to the US where we can get married, but I just want to make sure if this will actually work. I am a US citizen. I went to France in December and in January where we did an official engagement ceremony in church and I have plenty of pictures and proof. I wanted to know if anyone had any input on this since he is a refugee. I am in the midst of preparing the visa to send but im so worried because I have not been able to find anyone that can tell me if I need to do anything extra with his papers.. His Egyptian passport is still valid, so I was going to send a copy of that with the visa application plus his French asylum papers/work authorization etc (he doesn't have a French passport yet but we are praying it comes soon but it could take months)..any input would definitely help thanks

If he has residence in France - albeit temporary/refugee - you can apply for his K visa, provided you meet all other qualifications for a K-1 visa. He will not have a French passport until he becomes a citizen of that country. For the US Consulate what matters is his current country of residence. He may need to present his refugee papers to the US Consulate when he is called for his interview.

We want to get married, and live in the US but imnt sure if I need to do anything different when filing the Fiance visa. (I have had lawyers tell me to go back to france and get married there and that might be better but I have also heard that takes a long time for the papers to go through). I also have copies of His Egyptian passport which is still valid which I was going to send in with the application plus his French residency status. I am just worried that there is more I need to do since this is a bite different.

Please help I need all the support, input and prayers I can get :)

do you know if it looks bad that his is a refugee and he would be using a different passport then that of the country he is living in.

Side question how long should the letter of how you met should be?

I could be wrong, but since he's now in legal status in France, you shouldn't need to do anything differently than a normal case, as he can now do the interview in France.

He'll need to report where he's lived in the past and some questions might come up regarding Egypt, possibly may get an RFE if they want more information, but should be ok. You need to determine of you want to go to K-1 or CR-1 route.

His country of residence not being his country of citizenship does not help nor hinder, provided he is a legal resident of that country. It is quite common for Egyptians to seek residence in France - asylum or otherwise - because of previous and existing ties between the two countries; that should not seem odd to anyone.

There is no format for the letter of how you met. You need to make it concise and include only pertinent details, but the length will depend on the actual narrative.

My fiance and I also only had temporary residence status in Germany (albeit as students, not refugees) and were able to have everything done in Germany. I think it will be just the same for your fiance, all that matters is he has some legal residence in France that's more than a tourist, but does NOT have to be permanent residence. Just make sure you indicate clearly his country of origin and his current mailing address in France. They will also ask on the I-129F form which consulate you request to have your interview at.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
