So, USCIS emailed me a RFE notification on January 22...NEVER came... Waited 15 days and made a service request Feb 6 asking to please re send RFE by mail. Well, that mail never came either. Feb 13th I receive an email saying my RFE was "undeliverable" and sent back to USCIS. I call USCIS and they say "oh, sorry, we cant make any more service requests for you yet, call back three weeks later."

Yea right. I called next day to talk to a Tier 2 officer. I explained my situation, and told the officer, "whyyy do i need to wait a MONTH to request a new RFE letter be submitted! that is ridiculous its not even my fault!"

And she just said sorry they didn't even respond to your first request for re-sending RFE yet. give them time there has been holidays blah blah.

SOOO does any one know how long i need to keep waiting before i call back again and complain? and is anyone else having this problem?? its almost been a month already waiting for an RFE by mail :(

7/25/ 2013- Received NOA1 via email, file routed to NBC (priority date July 23)

7/29/ 2013- Received NOA1 Hard Copy in mail

This is just me personally (and I am impatient as all), but I would get on the phone with my senator and have them make a formal inquest. They can usually light a fire under an ####### or two.

I love a guy who looks like he could be on Criminal Minds as either an agent or a killer.

At least you got an e-mail. I read in here that USCIS basically issues an RFE, and does not mail or e-mail the petitioner. What happens at the end is USCIS denies the petition for not responding whereas neither the petitioner or beneficiary is aware that they are issued an RFE. Ridiculous. I would also contact my senator..

Yes exactly, and even the USCIS guy who assisted me said I don't get any extra time for my RFE, so keep track of whats happening just in case they deny our case for not responding to it! I will try to contact my senator.

I noticed that you did receive a hard copy on 1/18 about the transfer . Since then your mail is being sent back to USCIS . This is just a thought , but do they enter in your information again at CSC ? Perhaps some error was made on your address if this was done . Is there a way for the OP to verify the address with USCIS ? It would appear something has happened since the 1/18 transfer . Would a simple change of address correct any mistake made by USCIS ?

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I would do two things besides contacting Ombudsman and congressman office...

It can't hurt.

Email California Service Center explaining what happened. csc-ncsc-follwup@dhs.gov . Include your service request number from before on Feb 6. Explain the confusion is being created by agents you speak to since then on phone saying you have to wait two more weeks to follow up and you are worried that this will cause delay responding to RFE and possible denial. Ask them to please look into it.

Email the assosciate? director for service operations of all service centers, Neufeld, donald.w.neufeld@uscis.dhs.gov basically similar to what you send to California service center.

It can't hurt...Try it.

2/5/2014- Email/Txt I130 approved and notice mailed.
2/10/2014-Hard Copy NOA2. Approval

2/21/2014-Letter sent to request conversion for old I485 from employment to marriage with copy of I485 receipt and I130 approval
03/19/2014 - Service request to check on conversion request status.
04/04/2014 - Service request status through mail stating request received for conversion and file being prepared for transfer to local office.
04/08/2014 - I485 updated to "transferred to local office"
04/12/2014 - Received transfer notice in mail stating file transferred from Nebraska to NBC Lee Summit, Montana (so disappointed as I thought it was at local office now).
04/14/2014- emailed Nebraska and scopscata to see what's going on with file due to conflicting info I've gotten and NBC doesn't even show processing I485.
04/14/2014- Got response from scopscata saying will look into email, forward to resolution team.
04/14/2014- I485 updated to "485 was transferred and is now being processed at USCIS office"
04/25/2014- Text message and case update online "testing and interview" stage.
05/06/2014- Text message and case update online with interview date of June 11, 2014.
06/05/2014-Notice sent by NYC acting district director/office that interview date is Aug 21, 2014.....??????????? No change online
06/11/2014 - Interview for AOS. I130 was already attached. Approved and got passport stamped. YAY. Thank God.
06/19/2014 - Case updated online with text and email saying new card mailed.....

06/21/2014-Condtional GC received along with welcome letter.

You have to act very quickly.

You only have 89 days to respond to an RFE, and if you don't, they might deny your petition with the excuse that it is abondoned!

The members above gave some very good advise. I suggest you do eveything said above to ensure you don't get denied!!!!!!

I know many shy away from emailing Mr. Neufeld as I mentioned above as one worries about impact on your case. I did too. I don't know what worked for me but it sure did not backfire. I emailed the service center and few days later followed by emailing him, next day was approved. I do think it's worth a try. In your case, there's a RFE on the line and possible denial.

Yes I emailed Mr. Neufeld, and I think the worst that can happen, is if he ignores my email. Anyways, if my petition gets denied, I just have more proof how USCIS is at fault and how I was trying to solve the situation, with no help from them.. I will post if I get a response from anyone that I emailed about this, so if anyone else has this RFE problem they can follow my steps!
