Has anyone have this issue before?? I am trying to file my tax this year I talked to my tax preparer cause I've always filed single before and now that I am married and my husband papers is still in the NVC process My tax preparer told me that I have to wait for my husband to get her before I can file my taxes or else I will end up

paying more.

My question is last year I filed my taxes January 26,2013 for year 2012. we got married April 12,2012 is it ryt that I filed Single that time?? I am just worried if this will be a conflict when I do the Affidavit of support tax paper works.

So the issue typically is you can not file Married Filing Jointly without your spouse SSN and until he gets here he likely does not have one.

You are able to get an ITIN. I would recommend you ask someone with Phillipines specific experience the best way to do that in the Phillipines. The ITIN is issued by the IRS but getting the necessary notarization varies country to country.

You should ask your tax preparer if you can file Married Filing Seperate without your spouse SSN, I have hear different answers to that.

And finally when you finally get the SSN you should amend your tax return for 2012 and 2013 to married filing jointly and you should get additional money back.

thank you for your reply. Regarding the way I filed my taxes last year did I did the right thing? I filed single we got married April 2012 I filed my taxes Jan 26,2013? I filed for his petition May 09,2013

You are considered married for tax-filing purposes if you were married on the final day of the year, 31st December. If, on that day, you were married, then you must file either as married filing jointly or married filing separately for that tax year.

NLR how will I ammend? He's not here yet he's still on the NVC process? will that be a problem for AOS?

I didn't know that part my tax preparer did not tell me anything:((((( She didn't even explain that process.

You do not NEED your spouse to amend your taxes. I don't know how you amend them, I've never filed taxes in the USA. To file MFS you simply put NRA (non-resident alien) in the SSN spot and mail the taxes vs sending them electronically.

My husband applied for an extension last year because he didn't want to send them out by mail.


Call the IRS and ask them how to amend your taxes, or google it.

You do not NEED your spouse to amend your taxes. I don't know how you amend them, I've never filed taxes in the USA. To file MFS you simply put NRA (non-resident alien) in the SSN spot and mail the taxes vs sending them electronically.

My husband applied for an extension last year because he didn't want to send them out by mail.

Call the IRS and ask them how to amend your taxes, or google it.

Will that be a problem though? cause that's what my tax preparer adviced me to do it late until my husband gets here ... but I still have to send a copy of my tax to NVC if I do the affidavit of support I will send the 2012 paper work which says I 'm single?

Yes, you should file an amendment (form 1040x ) you can download it from the IRS website... It should be amended to,show married filing seperate, put NRA in the block for spouse SSN ten mail it in... Have a copy available to show during interview along with the other tax info... Good luck

My husband and I were married 2008. He filed SINGLE 2008-2012 since I was still in the Philippines.

That was also my dilemma during the NVC process and for the Embassy interview last year. At that time, my hubby is reluctant to change his filing status or even file for my ITIN.. I was never questioned about it during my interview at the Embassy..

It's technically a federal crime to intentionally lie on a tax return and misrepresent yourself as married when single, or single when married, for example. Just because you got married in another country doesn't magically mean that you aren't married.
