Hey! So.. I'm hoping I'm posting this in the correct area and I really need some answers because Google just isn't helping me today. Anyway, I am a Canadian citizen, born and raised and currently live here. My boyfriend is in the United States and he is an American citizen, born and raised there. We have been together for nearly 2 years and we want to get married. I'm going there in early to mid 2014 and we are hoping we can get married then. I realize I cannot stay in America, which is fine with both of us for now. My question is, are we able to get married in the US and can I come back to Canada alone then do all the paperwork and whatnot while I'm in Canada and he's still in the America? We don't know if we are going to be living in America or Canada yet. If it helps, he in in MA. Thank you :)

Me and my husband got married here in the U.S. with no problems and then sent in the paperwork a few days later (he's moving to the states). He has been coming and going with no problems. They just always ask both of us when we cross the border who is moving where and did we start the paperwork. Good luck and congrats :)

You can enter the USA to marry. Once you have done that he can file the petition for a C R 1 type visa the day after you marry or at any time in the future.

When you come into the country to get married, you may need to bring evidence of intention to return to country of origin (proof of home ownership/rental lease, letter from employer, etc.) It's unlikely, but if you cross the border or show up to Customs and say that you, a Canadian citizen, are in the country to marry an American citizen, that may be a red flag for them. If you are able to show them that you have every intention of going back, though, you shouldn't have any problems.

There is also the K-1 visa route. This visa allows you to enter the country to get married, and stay while you're applying for your green card. My British husband and I went this route. It took about 8 months.

Of course you can marry in the USA.

After that who have two options, to either both move to Canada and start the process for that immigration or go back to Canada alone and start the process for the CR1.

I suggest looking at both options (http://www.roadtocanada.com/forums/index.php and http://www.cic.gc.ca/english/ are both great for moving to Canada) and decide where you both want to live.

Also do a comparison of the different visa types for getting married in the USA. Ignore the K3 visa, it's obsolete and very rare. If you are wanting to stay and you live closer to Vancouver than Montreal, for example, a K1 visa might be the better option. Immigrant visa interviews ONLY happen in Montreal for all of Canada but fiancee visas are both Vancouver and Montreal.

Hey sorry I've been away with work for a while.. I'm curious to know what exactly is needed for him to be able to get me there after? My plan is to come back to Canada alone but we are unsure of what is required of him.. Is he going to have to sponsor me or is it different because I'm Canadian. Its just so tiring trying to find the correct information needed. Also, what is needed for ME when we get married in the US? Just my ID? This is so confusing.. :( Thank you again! <3

Also, if we get married in America.. Is he able to apply for AOS and I just stay there?.. And another thing that I wasn't too sure of... I have a criminal code conviction on my file.. (I received a .08 (DUI) in 2007) is that going to cause any issues for us? Its probably important to note that we have not actually met yet.. I know, seriously confusing. Thanks so much..again. :/

Okay you're getting married

so you follow this guide:

to get married you need to check into whatever state and county you'll be married in to see what is required. Most of the time you just need your passport.

I HIGHLY suggest going for a few visits or him coming to visit you before getting married. It's easy to be a person on the internet or phone and much harder to keep up that assumption when that person is there.

Also you cannot AOS because you have intent to stay. If you tried to get across the border you would be turned away if you said, "hey I'd like to go down and marry my fiance and stay in the USA" So you'd have to lie and that is misrepresentation which can lead to a lifetime ban from the USA if caught. So it's illegal.

The criminal conviction may cause some complication but I'm not sure what, however you'll need to be finger printed for your eventual police clearance certificate.


Also if you WANTED to do the K1, which is faster but costs a great deal more, you'd have to meet first in person before filing.

For the conviction, you are going to need to get a court-certified copy of your court documents and a certified copy of any probation or rehab program you had to go through. Get multiple copies of these, you will need them for everything you do in your immigration process (removal of conditions, citizenship). Also, you will need to get the police record check that uses your fingerprints, not just a name search (long time since I was in the CR-1 process, so if that is outdated info, sorry).
