Hi,

I wasn't sure where to post my question, so posted here, hoping it's the right form. If not, sorry.

I am a US Citizen and like my boyfriend who lives in India to visit me.

Please guide/suggest me the process for him to visit me, for us to stay together for atleast couple of months, as we plan on getting married but not until a year.

Please help! & thanks in advance.

There's no boyfriend visa.

He can apply for a tourist/visitor visa, but it can be tricky to get one for the purposes of visiting a fiancé (since the applicant will need to show that they have no immigrant intent in order to obtain said visa).

3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

1st May 2015 - 90 day RoC window opened

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

Your boyfriend applies on his own. He will be approved or denied based on his strong ties to India. There's nothing you can do to help him get an approval.

Thanks for response.

I don't believe being a US Citizen, I can apply tourist/visitor visa for him.

If so or if there is a possibility, please let me know, for me to apply for him to visit as a visitor and what is the duration that he can stay with me.

You cannot apply for him in any form or manner.

He can stay within the allowed time given to him at POE.

As stated above, your fiancé applies for the tourist visa and is either approved or denied based on HIS situation. Having a fiancé in the US actually hurts his chances. Being from India does not help either. Too many people from India have used the tourist visa as a way to immigrate to the US , so your fiancé will have to show that he has a very, very good reason(s) to return to India before they will issue him a tourist visa. He can try as it only cost the visa application fee, but if denied he will need to put that on the K-1 or IR-1/CR-1 visa application you both will apply for in the future. As a USC, you can visit him, but due to US immigration laws he may not qualify for a tourist visa to visit you. Many here on VJ on in the same situation where the foreign SO cannot come to the US, so the USC has no choice but to visit their country or find a third country both can visit.

P.S. do not get ahead of yourself by asking how long he will be able to visit. The first thing is to see IF he can visit. No tourist visa then the visit time is a big fat zero.

After marriage, you can file i-130 for him while he waits and stays in India. It will take more or less a year before he can immigrate to the US.

No. No YOU can NOT apply for a tourist visa for him.

He must apply on his own. He will be denied but he can apply as many times as he wants.

Once you are married you can petition for him to come to the USA with a C R 1 visa. That process takes about 12 months but in your case we are talking about India so it can take longer due to A P.

You cannot.

He, the foreigner, on the otherhand, can apply for a tourist visa in India . Usually, mentioned the word 'girlfriend in USA' is a great reason to deny, but firstly his eligibility is based on his strong ties to India, he has to prove those, as by Federal Law and Regulation he is first deemed an immigrant and must over come the immigrant label to the level the Vice-Consul understands.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
