Hi everyone ,

I just got married with my girlfriend and on my process of submitting the forms . The only thing that bothers me is i came in as F-1 student visa got a job in school so got my social security card so i continued studying untill i had some financial problems and could not pay my tution .. i was out of status and i'v been living in us for about 8 years and working using my social security card which says "valid for work only with dhs authorization" i have used my number and have been working for past 8 years ... My question is will i be in trouble if i mentioned my current job in any of the forms ..Should i just leave it as "none" on current job on form i-130 ???

If some one had gone through a similar case i would really appreciate your help ... thanks ...

What your doing is illegal , you will get into alot of trouble.

i dont condone what you are doing and its not fair for the people here that do the right thing and have to wait for the process while they cant work.

You will not be in trouble if you tell the truth. If you are working and you are asked about it, you must disclose your job, including income and proof you have been filing your taxes for the period of employment.

Illegal or unauthorized employment is usually forgiven with marriage to a USC. As Gegel said, be truthful and have your tax returns. If you haven't been filing taxes you will need to file all back taxes.

Yes, you need to be completely honest about your employment history. The fact that you've been paying taxes on your income is a point in your favour. Working illegally is not an issue for an immediate relative of a US citizen, such as a spouse, but you must declare all of it on your forms.

Be very careful.

How did you fill out the I-9 with your employers? Did you ever claim to be a US citizen? (on that form or otherwise)

Unauthorized employment is automatically forgiven/irrelevant for immigrants adjusting status based on an immediate relative petition (i.e. what you are doing). But false claims to citizenship are not forgiven, and can result in being deported and permanently barred from entering the US.

If there's any chance that you ever claimed to be a U.S. citizen, don't file anything with USCIS before retaining a good immigration attorney well-experienced with cases involving false claims to citizenship.

I didn't ever claimed to be a us citizen i always said "athourized to work" in that category ..and i have been filing my taxes since i'v been here ... and i just gave my ss number and my photocopy of my id that's all noone ever asked me to bring an original copy or anything ... i just was in the payroll ...
