Denied Visa at Interview

My boss just wrote (on company letter head) that upon my return to the US, I would be employed by the company, my position, and my rate of pay. He also included his email and phone if there were any questions.

06/07/2006- HE PROPOSES!!
12/13/2006- Glyn and Simon the best man fly in for wedding.
December 16,2006- Happiest day of my life
12/25/2006- Best and worst Christmas ever. Glyn flies back to England at 6 pm Christmas Night.
02/19/2007- UK spousal visa approved in NY after only 4 days.
March 2,2007- Reunited in England with Glyn.
01/21/2008-mailed I-130 to USCIS in London
01/24/2008-NOA1
04/13/2008-Panic. RFE received
April 17, 2008-Mailed off again.
April 22, 2008-NOA2 received dated April 21, 2008.
April 26, 2008-Packet 3 received
April 28, 2008-Mailed off DS-230
May06,2008-Packet 3 sent
May 08, 2008-Medical scheduled

Never received packet 3 although it was mailed to us on May 29th

07/17/2013-Sent off packet 3 after finally getting ALL our documents together

08/19/2013-Medical scheduled (there were earlier appointments but unfortunately, we couldn't get there for them due to hubby's work)

09/24/2013-Interview APPROVED

11/01/2013-POE BOSTON

01/13/2014-10 Year green card received

03/09/2019- Sent I-130 to Chicago lock box for step-son

03/20/2019- NOA 1

Timeline

It's so weird how different consulates require such radically different evidence. I was only asked if I intended to stay til the visa arrives and then return with my wife and step-son -- during her interview. They didn't even care to see documentation. The Filipino CO merely said to submit it if asked for it from the American CO.

Also, I thought simply stating you would return is evidence, too.

I live in the UK with hubby and we just were approved last week. Things I used to prove I would be re-establishing domicile in the US were, US bank account with a mailing address at the place we will be living at (mom and dad's), letter from my parents stating that we both would be living with them for a bit when we move back, and a letter from my soon to be employer stating that I would be working at the company when I return to the US.

Great action on your part and to help on understanding the establishing a return to USA.

Does this proof of domicile stuff apply if you're sending in stuff to the NVC and are a US resident? Do they require something extra at the NVC stage, like a voter registration card or driver's license?

Was the letter from your parents notarized? I am preparing one as well and I'm not sure if we should notarize or just submit with their original ink signature.

It is a Family Reunification visa so you need to show US domicile, not residence.

One set of rules, many interpretations.

No, it wasn't notarized. Just signed by them both. My dad was our co-sponsor so we just had them do it all at the same time and send the letter along with the I-864 and financial documents.

That's one problem with DCF each embassy want some different.

Not just for DCF actually and why sites like this and selfless members that share are valuable for research.

A lot of these thinsg are not published and sometimes for good reasons by the emabssy so as to not create a scammers bible of sorts.

So it is a requirement regardless of whether you live in the beneficiary's country or not? I don't ever remember reading about this in any of the guides or on the DOS website.

We went from the NVC and I am a US citizen. I also have a voter registration card and a drivers license. I sent in what I thought was enough to prove domicile during the NVC stage and they forwarded it to the Embassy who gave us an interview and then denied us based on this documentation.

ah! you are lucky. This afternoon I called the Embassy for clarification before I send them a bunch of worthless documents and they said "It will be extremely difficult to prove domicile to us while you live in Poland" Their suggestion is that I return to US and wait until they can "reunite" my husband and I. They also asked why I live in Poland... which I am sure is obvious.

ya, that's why you should be chasing after proof of re-establishing domicile (item #2 from my list)

instead of proof of domicile.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

this is ridiculous! you love this man, you got married, you made a family and your government wants you to leave your husband for ... nobody knows for how long cause these procedures take a bunch of time. it's against humans rights.

there are procedures in Poland too but separating family members is prohibited.

maybe the officer you were talking to or the one that interviewed your husband had a bad day.

can you please keep me updated cause our situation is very similar.
