Hi!!


My name is João, i'm from Portugal. My fiance lives in Los Angeles, CA.



My fiance received a letter on April of this year saying that our I-129F petition had been approved and that our case would now be forwarded to the embassy that would take care of the case and contact me.


August and no contact from the embassy. So i contacted them and they said that the case had been sent back to the NVC at their request (NVC request)


My fiance contacted NVC and USCIS and they told her that the embassy had terminated the case. they couldn't tell her why, or why i never got an interview, nothing since the petition was approved. One of the people she talked to even said, "maybe the interview went wrong"...she was like "there was no interview, he never received anything".


Today she was able to talk to a high manager at USCIS he told her that they had mailed her a notice today saying the petition was denied? she was like why? i mean, on what basis? since it was first approved in April. he couldn't answer.


she got the notice saying it was approved, and after no embassy contact, no interview, nothing, it got denied, i just don't understand.

Would really appreciate you guys help

i'm leaning towards 'you never receive packet 3 from consulate' because of mailing or address problems.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

the expiration date was August 23th. But i contacted the embassy before that date.

It makes no sense. Cause it wasn't denied by the embassy, or because of a bad interview or something.

How can the petion get approved by the USCIS and then denied by them?

I just don't get it.

And it's extremely frustrating the fact that no one on their side can help and give a clear answer, it's all this running around in circles

Yes.

Ask your petitioner to chase this down with a supervisor at NVC.

Ask your petitioner to chase this down with a supervisor at NVC.

She did, that's all she's been doing for the past few days.

And today she finally got to talk to a high manager, and the guy wouldn't even let her explain our case, he just said "we've mailed u a notice today, saying the petition is denied" and she was like.."but why, on what basis, no interview, nothing, the petition was aproved back in May!" and the guy just went on, i'm not authorized to give any information, a notice as been sent and instructions will be there.

Honest to god, this is bullshit. We really don't know what else to do.

What angers me, is that i had no interview, no packet, and we've filled for this back in September of 2012, 1 year, waiting, suffering over this, and for what!! It's extremely frustrating, we just want to get married and be together, simple as that. A portuguese man and a Mexican/American that want to get married. why do things have to be so complicated.

And then we do it by the book and you get screwed.

Sorry for the vent.

most likely your petitioner spoke with a Tier 2 human at USCIS.

Repeat for emphasis: Ask your petitioner to talk with a Supervisor at NVC.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I also lean towards they sent it out and never received. I thought Portugal had to interview in Paris now?

Have you visited America before? Or have you been refused a visa before based on misreprestation?

Yes i was in Los Angeles for 3 months last year, with her. No problem.

did u check ur receipt number in uscis website...so u will know if ur really approved...

Yes, i checked the receipt number back when it was approved, hell i have pics of the notice she got saying it was approved. Only now they say it's denied. Which i don't get since the embassy never contacted me, nothing.

I also lean towards they sent it out and never received. I thought Portugal had to interview in Paris now?

Yes Portugal interviews in Paris.
