OP (and other VJ friends), I had to leave my husband behind in December 2011... J-1 visa, two year rule requirement forced him to go home when he graduated. I stayed behind because I am still in school. We've been doing the long distance thing for almost two years now. We just filed the I-130 for the CR-1/IR-1 at the very end of July. I know how you feel and many people are going through this. No one wants to be apart from their spouse. We try to see each other every 3 - 4 months. Either I travel there or he comes here. (Since filing the I-130, I go there because the last time he came, the IO gave him a hard time for having a tourist visa while being married to me and filing, etc.) Anyway, hang in there. This is a true test of patience and a test of how strong a relationship is. Today was one of those "weak days" where I cried over Skype but I tell myself "this, too, shall pass". I am very glad to hear about the Overland Park location opening up either this Mon or the next.

I try to tell myself that it will pass as well, but I just can't bring myself to feel it will pass. The backlog just keeps getting worse and worse and I feel that my wife and I will never be together (obviously I don't mean never, but you get what I mean). I just don't see any light at the end of the tunnel and am losing faith the in the process because our federal government is so darned bureaucratic, bloated and slow!!

Who even knows if the Overland Park facility will help ease the backlog at all. Maybe it won't do anything to make things better. I have just have no faith or trust in any of this any longer....

May? Seriously? It wasn't that long ago it was typically taking 18 months to approve an I-130. I would take that as an historic norm,.

I know this may stir things up ...and no offense to the (k-1's) BUT I want to know why a person wanting to get married takes less time then a person already married? WHO thinks that this is a good idea? I think it's ridiculous!!

Hollyday, I don't know anything for sure. Like I said - it's all conjecture based on the answers provided by USCIS at the AILA conference in May. I would have thought that the Feb-April folks would have gotten acknowledgement that their petitions have been forwarded to local offices, if, indeed, that had happened, but I don't think we've seen many of these transfers here on VJ. The only one I've seen was a March filer that was transferred to the local office, and then RE-transferred back to MSC/NBC!

If February, March, or April I-130 filers HAVE gotten notification of a transfer to your local office, would you please holler here?

Nope, no transfer to local office here. And I haven't seen anyone on the April thread say their's have either...So files are piling up at NBC is seems.... terrible.

It was pointed out to me that a K-1 is essentially a specialized visitor's visa - because it has limitations on how long a person can remain in the US without marrying, and it's immediately cancelled if no marriage takes place.

An IR-1/CR-1 is a permanent visa so this means the petitioner may go under more scrutiny. Once it is granted, it's granted (I know - a CR-1 has a two-year limit). So the expectation is that IR-1s are looked at more intently than K-1s.

Don't know how much of this is true or not....but it might explain things a little. And, though I wasn't active on VJ at the time, I read that the K-1s were REALLY screwed up about a year ago - and they've straightened that process out. Hopefully the I-130 process will be back on track shortly!

I'm fairly certain that the new facility will do anything for filers from Feb and earlier. Those who haven't got approved are lost in the system, and we are the lowest priority. It seems likely that all the files that have been accumulating from May forward will start to be processed at the Overland Park facility. I also suspect they will start with June files so that it makes their stats look better.

But that's just my cynical opinion (based on what I've seen/read over the past ~2 years on VJ).

wow...that's awful. I really hope that isn't becoming the new norm now with all of the backlogs.

That must be rough. My wife was also subject to the J-1 2-year but luckily she spent summers back home during college and graduate school including a year to finish high school. In the end, she only owed 3-months which we just finished Sept 1st.

The J-1 rule is just a terrible idea. Nobody can anticipate when they fall in love.

Yep.. J-1's are evil. I tell my friends who want to come here for work or study to either get an F-1 (student) or H-1B instead.

Also what kills me is that people who filed the I-130 here along with the adjustment of status papers are zipping through the process. Whether they're here on an overstayed visa or are students changing their statuses, they are already at the interview process (and filed in July). No fair, indeed.
